Fine of 50 million VND if TV advertises falsely

Television stations that broadcast false information or advertisements can be fined up to 50 million VND.

In order to limit fraudulent acts through the television sales model, the law has been supplementing many regulations to increase the responsibility of related parties.

Accordingly, television stations - which provide technical solutions to disseminate advertising and sales programs of enterprises, and as a party directly involved in providing information to consumers, must also take joint responsibility to ensure accurate information for all parties.

Since 2010, the Law on Consumer Protection has had clear and specific provisions in Article 13 regulating the responsibility of third parties (television units) in providing information about goods and services to consumers.

Thus, television stations must be responsible for ensuring the accuracy and completeness of information about goods and services. To carry out this responsibility, stations are allowed to request businesses to provide documents to prove the advertising content and must take joint responsibility in case the advertising information is inaccurate.

According to Decree 19/2012/ND-CP on Regulations on administrative sanctions for violations in the field of consumer rights protection, Article 8 clearly states: A fine of VND 10,000,000 to VND 30,000,000 shall be imposed on organizations and individuals who are third parties and provide incomplete or inaccurate information about the goods and services provided; do not have evidence to prove or do not take all measures as prescribed by law to check the accuracy and completeness of information about goods and services.

In addition, the Decree also stipulates a fine of VND 30,000,000 to VND 50,000,000 for media owners and third-party media service providers who do not have technical solutions to prevent the media and services they manage from being used for the purpose of harassing consumers; allowing organizations and individuals trading in goods and services to use the media and services they manage to harass consumers.

Thus, if a television station violates its responsibility to provide information to consumers, it may be fined up to VND50 million and may be subject to additional penalties such as having its license or practice certificate revoked for 3 to 12 months.

With the above regulations on joint liability of television stations, in case consumers discover that advertising and sales businesses have signs of fraud, they can directly contact the television stations to report the signs of violation and request that the television stations be responsible for checking the information and taking timely preventive measures.
