Imprisonment for illegal sand mining on Lam River

(Baonghean.vn) - For repeatedly illegally mining sand on Lam River, Tran Van Hoa had to pay the price with a prison sentence.

On the afternoon of October 1, the People's Court of Nghe An province tried defendant Tran Van Hoa (born in 1989), residing in Hung Lam commune, Hung Nguyen district, for the crime of "violating regulations on resource exploitation".

According to the indictment, at around 0:15 a.m. on June 11, 2018, in Khanh Son commune, Nam Dan district, Tran Van Hoa directed 3 other people to pump sand from the Lam riverbed onto an iron-hulled boat with registration number NA-6104 (not yet registered). The legal owner of the boat is Mr. Tran Van Ngoc (residing in Hung Lam commune, Hung Nguyen district). While Tran Van Hoa was illegally mining sand, he was caught red-handed by the Environmental Police Department, Nghe An provincial police, and 81,351 m3construction sand

The area where the incident occurred has not been granted a license for mineral exploration and exploitation by a competent authority to any individual or organization.

The asset valuation conclusion dated July 11, 2018 of the Nghe An Province Asset Valuation Council concluded that 81,351 m3The construction sand that Tran Van Hoa illegally exploited was worth 19.9 million VND.

In addition to the above-mentioned acts, in 2017 and 2018, Tran Van Hoa was twice administratively sanctioned. Specifically, on October 3, 2017, he was sanctioned by the Environmental Police Department, Nghe An Provincial Police, for "illegal mineral exploitation." On January 22, 2018, he was sanctioned by the Hung Nguyen District Police for "violating mineral exploitation without a mineral exploitation license from a competent state agency."

Considering the case comprehensively, the People's Court sentenced Tran Van Hoa to 9 months in prison and handled the evidence according to the law.

Previously, on September 25, 2018, the People's Court of Nghe An province also sentenced defendant Nguyen Khac Nham (born in 1992), residing in Hung Lam commune, Hung Nguyen district, to 9 months in prison for "violating regulations on resource exploitation" with evidence of 51.16m3construction sand
