Defendant Bao Nguyen is the Director of Ha Thanh Construction Limited Liability Company, who slandered the Secretary of Me Linh District Party Committee, Mr. Luu Tien Long (57 years old, residing in Yen Hoa ward, Cau Giay district, Hanoi).
According to the indictment of the Hanoi People's Procuracy, defendant Bao was a delegate of the Hanoi People's Council from 2008 to 2011. During his time living in the locality, Mr. Bao believed that in the work of transferring cadres, the Secretary of the Me Linh District Party Committee, Mr. Luu Tien Long, had handled the matter unreasonably. Therefore, Mr. Bao did not want Mr. Long to continue to be the Secretary of the Me Linh District Party Committee for the 2015-2020 term, so he intended to spread bad news about Mr. Long.
To achieve his purpose, in mid-July 2015, defendant Bao drafted an anonymous letter with many fabricated contents, defaming Mr. Long. Then, on July 29-30, Mr. Bao sent 155 anonymous letters (express mail) with the above content to delegates attending the Me Linh District Party Congress for the 2015-2020 term, aiming to insult Mr. Long's honor so that the delegates would not elect Mr. Long to the Me Linh District Party Executive Committee for the 2015-2020 term, and would not elect Mr. Long to continue holding the position of Secretary of the Me Linh District Party Committee.
During the investigation, the investigating agency also determined that some subjects related to this case were defendant Bao's nephews. However, these subjects did not know that Bao committed the crime and only helped Mr. Bao send petitions and letters, so the investigating agency did not mention handling them.
At the trial, defendant Bao admitted that he was aware that the above actions were intended to defame, slander, offend the reputation, honor, dignity, and lower the prestige of Mr. Long with the purpose of making the delegates attending the Me Linh District Party Congress not vote to elect Mr. Long to the District Party Executive Committee, as Secretary of the Me Linh District Party Committee for the 2015-2020 term. However, for personal purposes, defendant Bao still committed the act of slandering Mr. Long as stated above.
After consideration, defendant Bao confessed honestly, repented and asked the Trial Council to consider and reduce his sentence so that he could have the opportunity to correct his mistakes... The Trial Council sentenced defendant Bao to 9 months in prison for the crime of "Slander"./.
