In particular, opening mobile trials is considered one of the effective solutions, because through this, people can "see with their own eyes, hear with their own ears" and clearly understand each behavior and case.

Organize public court sessions at the grassroots level

On the morning of May 10, 2023, at the Quynh Hau Commune Cultural House, the Quynh Luu District People's Court held a public mobile trial of the case of illegal drug trafficking and organization. 7 defendants were brought to trial in the case of "Illegal drug trafficking and organization of illegal drug use" including: Lo Thi Nguyet Nhu, residing in Tuong Duong District; Luong Vien Duong, residing in Thanh Chuong District and 5 defendants all residing in Quynh Hau Commune: Le Dai Nghia, Nguyen Thanh Luan, Nguyen Van Duc, Nguyen Tien Anh, Nguyen The Anh.

From early morning, the hall of the Commune Cultural House was packed with people. When the court clerk announced the names of the defendants, many people could not help but feel sorry, because most of the defendants were young and had been caught up in the law. During the debate, the panel of judges incorporated legal provisions to disseminate to the people. Mr. Tran Duc Hung, a resident, said: When the commune People's Committee officer informed me that there was a mobile trial, even though I was busy with family matters, I still arranged for all family members to attend. Trials like this are very necessary. From the debate to the verdict, it shows the strictness of the law, which has a great effect in deterring and warning everyone, especially young people.

Also in the form of organizing a mobile court, in early April 2023, the People's Procuracy of Thanh Chuong district coordinated with the People's Court of the same level and Thanh Chuong District Youth Union to organize a court session right at Thanh Chuong I High School. The subjects brought to trial were Nguyen Van Trong for the crime of "Illegal possession of narcotics" and Tran Van Ngai for the crime of "Theft of property".

Through the process of questioning, indictment and litigation, the prosecutors of Thanh Chuong District People's Procuracy propagated, disseminated and educated the law so that people, especially students attending the trial, could improve their understanding of the State's management of narcotics, thereby reminding them to strictly comply with the law, raise their vigilance, denounce crimes and legal regulations related to drugs and property infringement.

Previously, on March 17, 2023, at the People's Committee of Tri Le Commune, Que Phong District, the Provincial People's Court also tried 3 criminal cases on the crimes of "Illegal drug trafficking", "Illegal possession of military weapons", "trafficking in women". At the trial, the Trial Council also educated and disseminated the law to people in mountainous and border areas.

Ms. Luong Thi May, a local resident who attended the trial, said: Trials like this help mountainous women understand the schemes and tricks of human traffickers so that they can avoid becoming victims themselves and their loved ones. Therefore, organizing mobile trials, especially in remote areas, is really necessary.

According to Ms. Lang Thi Hang - Head of the Justice Department of Que Phong district: The level of legal knowledge of people in mountainous, remote and isolated areas is still limited, so the mobile court is the most visual form of propaganda, thereby helping people "see with their own eyes, hear with their own ears" and clearly understand each specific act and case. The sentences that the defendants received to pay for their mistakes are also a real warning to all those attending the trial.

Select typical cases

According to statistics from the Provincial People's Court, since the beginning of the year, the People's Courts at 2 levels have brought 51 mobile cases to trial, mainly for crimes such as: Buying, storing, and organizing illegal use of drugs; theft of property, intentional injury, illegal possession of military weapons, human trafficking... In reality, although authorities at all levels have actively disseminated and provided relevant documents, many people, especially those in remote areas and ethnic minority areas, still have a vague understanding of the law due to limited awareness. Therefore, it is necessary to open mobile courts.

It is clear that most of the court sessions at the Court headquarters are often empty, in addition to the participants summoned by the Court, there are only a few relatives of the defendant, and there are even sessions with only the defendant. Meanwhile, mobile trials often attract a large number of attendees, and many places have to conduct trials outdoors so that everyone can follow. Therefore, the effectiveness of the form of popularizing and educating the law through mobile trials cannot be denied. Through this, people can access the provisions of the law in a proactive, intuitive, easy-to-understand, and easy-to-absorb manner.

In particular, analyzing and evaluating the behavior of criminals based on documents and evidence not only reflects the views of the Procuracy and the Court but is also a way to promote the spirit of the rule of law. Student TVH, a student at Thanh Chuong I High School, shared: “I think that with the strict sentences announced and everyone watching the mobile court hearing, it will be the most concrete evidence, showing the clearest consequences if someone violates the law, they will have to pay the price. Therefore, this is a necessary form of legal propaganda, especially for students and teenagers when they start to enter life with many surprises and temptations…”.

Mr. Pham Hong Trang - Deputy Chief Justice of the Provincial People's Court said that, clearly identifying the advantages and difficulties, in the coming time, the People's Courts at 2 levels will continue to strengthen the organization of mobile trials in the area. In particular, focusing on selecting typical cases, at the same time closely coordinating with local authorities to best prepare the necessary conditions for the location of the trial, selecting the presiding judge, people's assessors, court clerks... arranging security forces before, during and after the mobile trials so that the mobile trials are truly effective, contributing to the propaganda, dissemination, education of the law and being a bridge to bring the law closer to the people.
