The Standing Vice Chairman of Nghe An Provincial People's Council proposed to remove obstacles when applying labor contracts according to Decree 111.
Currently, the implementation of the policy under Decree No. 111/2022 on contracts for certain types of work in administrative agencies and public service units has many problems.
On the morning of November 26, the Legal Committee of the Provincial People's Council reviewed the draft Resolution approving the total number of employees and contract workers receiving salaries from the State budget in public service units and Association organizations in 2025 to prepare for the 25th Session of the 18th Provincial People's Council, term 2021 - 2026.

Attending the working session were comrades: Nguyen Nam Dinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Council; Nguyen Nhu Khoi - Member of the Provincial Party Executive Committee, Vice Chairman of the Provincial People's Council.
Comrade Pham Thanh Chung - Standing Member, Head of the Legal Committee of the Provincial People's Council chaired and directed. Also attending were leaders of the Provincial People's Council Committees, the Provincial People's Committee Office and the Standing Committee of the Vietnam Fatherland Front Committee of Nghe An province; and the drafting agencies.
Decrease by 1,241 people compared to 2024
Implementing the Plan and Notice of the Provincial Party Standing Committee, the Provincial People's Committee submitted to the Provincial People's Council for approval that the total number of employees receiving salaries from the budget in public service units that have not yet self-financed regular expenditures and Association organizations in 2025 is 56,807 people, a decrease of 1,241 people compared to 2024 and a decrease of 4,077 people in the 2022-2024 period (equivalent to a decrease of 7.28% compared to 2021).

Of which, provincial-level public service units and association organizations assigned 13,476 people, a decrease of 249 people compared to 2024. District-level public service units assigned 43,307 people, a decrease of 982 people (of which educational public service units assigned 42,185 people, a decrease of 965 people) and the 2022-2024 period decreased by 1,921 people. The reserve in 2024 is 24 people, a decrease of 10 people compared to 2024.
In addition, the Provincial People's Committee proposed that the Provincial People's Council consider and add 502 quotas (from 35 quotas to 537 quotas) for contract workers under 12 months in educational public service units of group 4 according to Decree No. 111/2022/ND-CP of the Government.
It is known that in 2024, the Provincial People's Council assigned the total number of employees and contract workers receiving salaries from the State budget in public service units and Association organizations to be 58,048 people. On that basis, the Provincial People's Committee assigned the number of employees receiving salaries from the budget to public service units and Association organizations in 2024 to be 58,014 people; reserve 34 people.
As of September 1, 2024, the total number of civil servants is 56,164 people (1,850 positions remaining, of which 1,241 positions will be reduced in 2024 and the recruitment process is in progress to replace retired people, downsized people, etc., which is 609 people).
Proposal to review the demand for contract labor
At the review session, the Legal Committee agreed that the total number of employees in public service units that have not yet self-financed regular expenses and organized the Association in 2025 is 56,807 people.
However, regarding the approval of the number of contract workers receiving salaries from the district budget according to Decree No. 111/2022 on contracts for certain types of jobs in administrative agencies and public service units, the Legal Department requests the Department of Home Affairs to review the demand for contract workers with a term of no more than 12 months to work in specialized job titles and shared professional job titles in group 4 units in the education and health sector of localities in the province to propose the Provincial People's Committee to submit to the Provincial People's Council for approval of the number in 2025, avoiding cases arising as in 2024; the number ensures the prescribed ratio.
At the same time, it is recommended to note that the signing of labor contracts at these units must comply with the regulation that it is not allowed to sign more than 2 labor contracts with a fixed term according to the provisions of the Labor Code: "In case the two parties sign a new labor contract with a fixed term, they can only sign it once more. After that, if the employee continues to work, they must sign an indefinite-term labor contract".
In addition, comments also requested the drafting agency to provide further explanation on the assignment of 1,013 public preschool and general education civil service positions for the 2024-2025 school year; provide further explanation on the fluctuations in the number of employees receiving salaries from the revenue of district-level public service units; the streamlining roadmap in the coming years; the number of positions and the number of contracts according to Decree 111 for the Rescue and Disaster Prevention and Control Center of the town...

Speaking on this issue, Permanent Vice Chairman of the Provincial People's Council Nguyen Nam Dinh acknowledged that in the past two years, Nghe An has been allocated many positions in the education and training sector by the Central Government, accounting for 10% of the whole country in two additional rounds.
On that basis, the province has been very proactive in implementing, in which the Department of Home Affairs has agreed on the principle of "decentralization to the district level to recruit staff from preschool to secondary school".
Comrade Nguyen Nam Dinh suggested that the Department of Home Affairs pay attention to urging and checking, avoiding the situation of "when there is no staff, they complain, but when there is, they do not recruit enough, not meeting the standards", especially for special teachers such as subjects: Foreign Languages, Information Technology, Music and Art.
The Standing Vice Chairman of the Provincial People's Council also expressed concerns when implementingDecree No. 111/2022Regarding contracts for some types of work in administrative agencies and public service units, many problems have arisen. Notably, the implementation of this Decree has gone against the principle of ensuring that workers' income is not lower than before when the policy changes. Therefore, he requested the Department of Home Affairs to guide the implementation and ensure the rights of workers.

Director of the Department of Home Affairs Nguyen Viet Hung explained and clarified the related contents. Based on the discussion, Head of the Legal Committee of the Provincial People's Council Pham Thanh Chung requested the Department of Home Affairs and the Provincial People's Committee to accept the opinions to complete the draft Resolution to submit to the Provincial People's Council at the 25th Session.
