According to the draft Law on Social Insurance being submitted for comments by the Ministry of Health, during pregnancy, female workers are allowed to take 5 days off for prenatal check-ups, 1 day each time. In case the medical facility is far away or the pregnant woman has a medical condition or the pregnancy is abnormal, she is allowed to take 2 days off for each prenatal check-up.

Maternity leave is calculated in working days, excluding holidays, Tet holidays, and weekly days off.

Also according to the draft, in case of miscarriage, abortion, suction curettage or stillbirth, female employees are entitled to take maternity leave as prescribed by a competent medical facility and a maximum of 10 days if the pregnancy is under 5 weeks old; a maximum of 20 days if the pregnancy is from 5 weeks old to under 13 weeks old; a maximum of 40 days if the pregnancy is from 13 weeks old to under 25 weeks old; a maximum of 50 days if the pregnancy is 25 weeks old or older. The time off work to enjoy maternity leave includes holidays, Tet holidays, and weekly days off.

Female employees who give birth are entitled to 6 months of maternity leave before and after giving birth. In case a female employee gives birth to twins or more, from the second child onwards, the mother is entitled to 1 additional month of leave for each child. The maximum maternity leave before giving birth is 2 months./.
