National Assembly votes to pass the draft Land Law
On the morning of November 29, the 6th Session of the 13th National Assembly passed the draft Land Law (amended) with 89.96% of the total number of National Assembly deputies voting in favor.
Thus, after the Constitution, the Land Law (amended) - the law that has received great attention from public opinion, voters and people nationwide, has been approved by National Assembly delegates.

This event marks an important milestone in the process of building and receiving comments from all walks of life, intellectuals, and voters nationwide on the Land Law (amended), a law that has a wide coverage in all areas of social life.
Previously, implementing the Resolution of the National Assembly Standing Committee, the draft Land Law (amended) was organized to collect public opinions and received nearly 7 million comments.
At the 5th Session, the National Assembly continued to discuss and give opinions on the draft Law on Land (amended) and agreed to postpone the time of passing the draft Law on Land (amended) so that the examining agency, the drafting agency and relevant agencies have time to study, absorb and revise the draft Law thoroughly, ensuring consistency and synchronization between the provisions of the draft Law and the provisions on land in the draft of the amended 1992 Constitution.
Chairing the session, Vice Chairwoman of the National Assembly Nguyen Thi Kim Ngan stated that with the awareness that the draft Land Law (amended) is an important law with great impact on organizations, individuals, and households using land, affecting the country's economic development and affecting the whole society, the National Assembly, the National Assembly Standing Committee, the Government and relevant agencies have spent a lot of time and effort to carefully and thoroughly research and take cautious steps.
The Government has prepared carefully and discussed many times. The National Assembly Standing Committee has spent 5 sessions to give opinions, and the National Assembly has spent 3 sessions to discuss and give opinions. In addition, the reviewing agency and the drafting agency have organized many conferences and seminars to collect opinions from organizations, individuals, sectors, levels, localities and subjects affected by the Law.
Before voting, the National Assembly listened to the presentation of the Report explaining and accepting the opinions of National Assembly deputies on the draft Law on Land (amended) by the Standing Committee member of the National Assembly, Chairman of the Economic Committee of the National Assembly Nguyen Van Giau.
Accordingly, the draft Land Law (amended) has been carefully and seriously prepared, with many innovations; consistent with the viewpoints and orientations for innovation of land law policies according to the Resolution of the 11th National Party Congress, Resolution No. 19-NQ/TW of the 6th Conference of the 11th Party Central Committee, has basically resolved current problems and difficulties, meeting practical requirements and the situation of socio-economic development and international integration.
The Land Law (amended) passed by the National Assembly at the 6th Session has 14 chapters and 212 articles.
Before approving the full text of the draft Land Law (amended), National Assembly deputies also voted to approve a number of contents such as Article 26 on State guarantees for land users; Article 126: Land used for a limited period and Article 166: General rights of land users in the Draft Law.
The draft Land Law (amended) passed by the National Assembly this time adds a number of cases of land recovery for use in national defense and security purposes such as building offices; training and professional development centers, resorts, compulsory education facilities, reform schools; and clarifies the authority to allow land recovery stated in Clause 1, Article 62 of the draft Law to avoid arbitrariness in land recovery.
The Land Law (amended) also stipulates that the Government shall specify in detail the procedures for enforcement to be applied uniformly throughout the country because this is a complicated issue and is related to the rights and interests of the people; and specifically stipulates compensation for damages caused by land requisition.
The Law also adds provisions on compensation for non-agricultural land of residential communities and religious establishments in the group of provisions on compensation and resettlement support when the State reclaims land.
Regarding the land price framework, the revised Land Law has added provisions on the participation of land price consultancy agencies in the Land Price Appraisal Council to ensure objectivity in Clause 3, Article 114: "The Provincial People's Committee decides on specific land prices. The provincial land management agency is responsible for assisting the Provincial People's Committee in organizing the determination of specific land prices. During the implementation process, the provincial land management agency is allowed to hire an organization with the function of land price consultancy to advise on determining specific land prices."
Notably, in the Land Law (amended) passed by the National Assembly this time, land relations according to the market mechanism have been strengthened, specifically: Limiting cases of land allocation by the State, basically shifting to applying the form of land lease; implementing land valuation according to the market mechanism with State management to move towards eliminating subsidies in land management and use, overcoming the situation of "asking-giving" in land use.
The Land Law (amended) has also completed regulations to increase people's participation in the process of making and organizing the implementation of land use planning, plans, compensation, support and resettlement plans to ensure transparency in land management and use, contributing to preventing and combating negativity, corruption, waste and reducing complaints in the land sector; at the same time contributing to improving the effectiveness and efficiency of state management of land.
Also during this morning's working session, National Assembly deputies continued to discuss in the hall the draft Law on Bankruptcy (amended). In the afternoon of the same day, the National Assembly will hold its closing session, which will be broadcast live on television and radio for people and voters nationwide to follow./.
