The National Assembly listened to Member of the Standing Committee of the National Assembly, Chairman of the Law Committee of the National Assembly, Member of the Draft Amendment Committee of the 1992 Constitution, Head of the Editorial Board of the Draft Amendment to the 1992 Constitution Phan Trung Ly present a Report explaining the reception of opinions of National Assembly deputies and opinions of the people on the Draft Amendment to the 1992 Constitution and the Submission of the draft Resolution on the implementation of the 1992 Constitution (amended in 2013).

In addition, the National Assembly also listened to the Report on the inspection of anti-corruption work in 2013. The report on the implementation (including the issuance of detailed regulations and implementation instructions) of laws and resolutions passed by the 13th National Assembly was discussed in the hall.

On January 2, 2013, the Draft Amendment to the 1992 Constitution was announced for public comment. On May 19, 2013, the Editorial Board had a Report summarizing public comments on the Draft Amendment to the 1992 Constitution (from January 2, 2013 to April 30, 2013) sent to the National Assembly deputies at the 5th session. From May 1, 2013 to September 30, 2013, there were 685 letters and documents of comments from agencies, organizations and individuals sent to the Draft Amendment to the 1992 Constitution Committee.

The 1992 Constitution (amended in 2013) has many changes in content and has adjusted the tasks and powers of a number of state agencies. To implement a number of new provisions of the Constitution and the contents that have been changed and adjusted in the Constitution, there must be provisions that ensure both transition and stability and continuity of the state apparatus; at the same time, there must be a certain period of time to review, study, amend, supplement or promulgate new laws, ordinances and related legal documents in accordance with the new provisions of the Constitution. Along with that is the regulation on the effective date of the Constitution.

The National Assembly's issuance of a Resolution stipulating a number of points on the implementation of the 1992 Constitution (amended in 2013) is also consistent with the practice of amending and implementing previous Constitutions such as the 1946, 1959, 1980 and 1992 Constitutions, which were adopted. The National Assembly all issued Resolutions stipulating a number of points on the implementation of the Constitution to ensure the stability and continuity of the state apparatus and the legal system during the transitional period between the implementation of the new Constitution and the current Constitution.

To ensure the position and role of the Constitution as a document with the highest legal effect, it is necessary to specifically determine the effective date of the Constitution. The 1992 Constitution defines the promulgation of the Constitution, laws, and ordinances under the authority of the President. Therefore, the Standing Committee of the National Assembly proposes that the 1992 Constitution (amended in 2013) take effect from the date of promulgation by the President, as stipulated in the effective date of the 1980 Constitution and the 1992 Constitution.

The implementation of the 1992 Constitution (amended in 2013) is related to the organization and operation of the current state apparatus such as: the National Assembly and its agencies, the President, the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, the People's Councils, and the People's Committees at all levels cannot be reorganized immediately according to the new provisions of the Constitution, so the Draft Resolution affirms that these state agencies will continue to perform their duties until they are replaced by corresponding state agencies in accordance with the provisions of the 1992 Constitution (amended in 2013).

The Standing Committee of the National Assembly proposed the implementation of provisions of the 1992 Constitution (amended in 2013) regulating the functions, tasks and powers of a number of state agencies, such as: the President's conferment, promotion, demotion and stripping of military ranks of general officers; the Standing Committee of the National Assembly's approval of the positions of Vice Chairman of the Nationalities Council, Vice Chairman of the National Assembly's Committees and other members of these agencies.

To ensure that the system of legal documents is consistent with the 1992 Constitution (amended in 2013) and at the same time ensures stability for development, the National Assembly Standing Committee proposes that the Resolution stipulates that laws, ordinances and other legal documents promulgated before the effective date of the 1992 Constitution (amended in 2013) must be reviewed for amendment or newly promulgated to be consistent with the 1992 Constitution (amended in 2013).

At the same time, in order to have a legal basis for organizing state apparatus institutions in accordance with the provisions of the 1992 Constitution (amended in 2013), the amendment and supplementation of the Law on Organization of the National Assembly, the Law on Organization of the Government, the Law on Organization of the People's Court, the Law on Organization of the People's Procuracy, the Law on State Audit, the Law on Election of National Assembly Deputies and People's Council Deputies and the new development of the Law on Local Government need to be carried out urgently and must be promulgated before 2016.
