National Assembly discusses draft Law on National Reserves
National Assembly delegates agreed to narrow the regulations on the goals of national reserves.
At the 3rd session of the 13th National Assembly, the National Assembly gave its opinions on the Draft Law on National Reserves (NDR). Immediately after the session, the National Assembly Standing Committee (NASC) directed the Standing Committee of the Finance and Budget Committee to coordinate with the drafting agency and relevant agencies to seriously absorb the opinions of the NA deputies and revise and complete the Draft Law to be submitted to the National Assembly at the 4th session.
On the afternoon of October 24, after listening to the Report of the Standing Committee of the National Assembly explaining, accepting and revising the draft Law on National Reserves, the National Assembly discussed in the hall a number of contents with different opinions of this draft Law.
Narrowing the national reserve target
Many opinions agree with the explanation of the Standing Committee of the National Assembly that it is necessary to have a provision regulating the objectives of the National Reserve in the law. Because determining the objectives of the National Reserve is closely linked to the allocation of corresponding resources to implement the set objectives. Therefore, it is necessary to have a provision clearly defining the objectives to create a legal basis for allocating the State budget for the National Reserve.
National Assembly delegates also agreed to propose focusing only on the goal of preventing, combating and overcoming the uncertainties and consequences of natural disasters, fires and epidemics.
The explanatory report of the Standing Committee of the National Assembly clearly stated that even in developed countries with strong national defense potential, national defense resources are only used to respond to defense, security issues, and emergency situations, especially serious ones.
Therefore, taking into account the opinions of the National Assembly Deputies, to ensure that it is consistent with the nature of the National Reserve and avoid spreading it out, the Standing Committee of the National Assembly has revised the content in the direction of narrowing the objectives of the National Reserve. Accordingly, Article 1 of the Draft Law stipulates: “The State forms and uses national reserves to proactively meet sudden and urgent requirements for preventing, combating, and overcoming the consequences of natural disasters, fires, and epidemics; serving national defense, security, and performing other sudden and urgent tasks of the State”.
However, many opinions suggested that the use of the phrase “other urgent, extraordinary tasks of the State” should be considered. According to delegate Ngo Van Hung (Lao Cai delegation), if it is not possible to specifically state what the “other” tasks are, then this phrase should not be included. Sharing the same opinion, delegate Pham Xuan Thuong (Thai Binh delegation) said that using the phrase “other urgent tasks of the State” has unintentionally broadened the target.
Policy for people working in national defense
Regarding policies for national reserve workers, the draft Law stipulates: National reserve workers are entitled to seniority allowance; depending on the field of work and job undertaken, they are entitled to preferential occupational allowance.
Many opinions expressed agreement with this regulation, because people doing this job have special characteristics, having to work in an environment with toxic factors. Therefore, the regulation of receiving seniority allowance will demonstrate the right concern and regime for employees.
However, delegate Le Nam (Thanh Hoa delegation) suggested that the law should not be too specific in regulating the regime for people working in national reserves in order to facilitate the implementation of salary policy./.
