The National Assembly discussed the Draft Law on Handling Administrative Violations.
(Baonghean) -This afternoon, November 10, the National Assembly discussed in groups the Draft Law on Handling Administrative Violations. The provincial National Assembly delegation discussed in group number 5 with two other National Assembly delegations from Vinh Phuc and Dak Lak provinces.

Participating in the discussion in groups, most of the National Assembly deputies of Nghe An, Vinh Phuc and Dak Lak provinces highly agreed with the draft Law on Handling Administrative Violations, which consists of 06 parts, 11 chapters and 165 articles. The deputies said that the promulgation of the Law will contribute to improving the effectiveness and efficiency of State management and social management. Overcoming shortcomings in the implementation of legal provisions on handling administrative violations, thereby raising citizens' awareness of law compliance, meeting the requirements of fighting and preventing administrative violations.
Delegates suggested that the authority to handle administrative violations should remain as it is now and be assigned to the court. Some delegates suggested that the Law should have provisions to give people the right to express their opinions when they are punished for their violations. Regarding the scope of regulation, delegates said that this is a very broad Code that has a great impact on life, so the Drafting Committee needs to carefully study the practical legal provisions on handling administrative violations, summarize and include them in the draft law, overcome the situation where the law only provides general regulations, review and classify documents to avoid overlap. In addition, promote propaganda and education, raise awareness of the law as well as bring the law to all people, especially in remote areas and ethnic minority areas.
Regarding the issue of increasing fines for administrative violations, most delegates agreed. Particularly for the inner-city areas of the five centrally-run cities, delegates proposed that the Government prescribe higher fines, but not exceeding twice the general fine, applicable to the same violation in the fields of traffic, environment and urban management and order, based on the proposal of the People's Council of centrally-run cities. Such regulations will ensure strictness and deterrence for violators.
Delegates also suggested that the Law should remove the regulation on sending prostitutes to medical facilities. It should improve management and social awareness of prostitutes. It should rearrange the wording to avoid duplication and separate administrative measures for minors into a separate chapter.
Tomorrow, November 11, in the morning, the National Assembly will pass the Resolution on the National Assembly's Supervisory Program in 2012 and discuss the draft Law on Deposit Insurance. In the afternoon, the National Assembly will vote to pass 4 laws: Law on Archives, Law on Measurement, Law on Complaints and Law on Denunciation.
