National Assembly discusses the Law on Judicial Expertise
(Baonghean) -This afternoon, November 15, the National Assembly discussed in groups the Draft Law on Judicial Expertise. The National Assembly delegation of Nghe An province discussed in group number 5 with two delegations of National Assembly deputies from Vinh Phuc and Dak Lak provinces.Attending the discussion was comrade Cao Duc Phat - Minister of Agriculture and Rural Development.

Speaking at the discussion, most of the National Assembly deputies emphasized that after 5 years of implementing the Ordinance on Judicial Expertise, judicial expertise work has achieved certain results. The system of judicial expertise organizations in the fields of forensic medicine, forensic psychiatry, and criminal techniques at the central and local levels has been consolidated and improved, and the team of judicial experts has been strengthened. National Assembly deputies said that currently, the Ordinance on Judicial Expertise and judicial expertise work have revealed a number of limitations and inadequacies such as: lack of specific regulations on conditions and solutions to implement the policy of socialization; many regulations in the Ordinance are not clear, specific, and there is no synchronization and connection between the provisions of the law on criminal, civil, and administrative procedures and legal documents on judicial expertise. In response to practical requirements as well as to ensure consistency and unity between the provisions of judicial expertise and the provisions of relevant laws, especially the law on litigation, delegates said that it is necessary to promulgate the Law on Judicial Expertise. However, delegates suggested that the law should supplement and clearly stipulate the coordination mechanism of the litigation agency as well as the responsibilities of all levels in judicial expertise.
National Assembly deputies from Nghe An, Dak Lak and Vinh Phuc provinces said that the Law should not require the litigant to conduct the proceedings when the litigant does not conduct the appraisal, only then is he entitled to request the appraisal. Regarding the issue of socializing judicial appraisal, some deputies suggested that judicial activities should not be socialized. However, some are still concerned about the feasibility, the reason being that the ability of the state to manage and control is difficult, and when it is difficult to control, it will lead to negativity that distorts the results of the investigation and trial.
National Assembly deputies suggested that the law should also specify the procedures for first, second and third forensic examinations. Regarding forensic examinations by provincial police, there were two opinions: one agreed to remove it and the other suggested not to remove it because the feasibility of this law was not high.
Tomorrow, November 16, in the morning, the National Assembly will discuss in the hall the draft Law on Prevention and Control of Tobacco Harms. In the afternoon, it will discuss in groups the draft Labor Code (amended) and the draft Trade Union Law (amended).
