Quy Chau: Need to resolutely reclaim forestry land granted to the wrong subjects
(Baonghean) -Two years ago, Nghe An Newspaper reported on the slow recovery of forest land granted to the wrong subjects in Khe Ban area, Chau Hoi and Chau Hanh communes (Quy Chau), according to the conclusion of the Provincial People's Committee on March 23, 2007. Up to now, after five years of making the recovery decision, there are still some cases that have not returned the land to the state. Regarding the recovery of forestry land in Hanh Tien village, Chau Hanh commune, Mr. Tran Quang Hong - deputy editor in chief was indignant: "The forestry land area of Hanh Tien village previously assigned to the wrong subjects was more than 47 hectares, divided among 10 district officials with permanent residence in Tan Lac town. After the District People's Committee issued Decision No. 598 dated June 29, 2007 "on land recovery and cancellation of Land Use Right Certificates of wrong subjects in Chau Hanh commune", most of the cases where land was granted wrongly have returned the land to the locality, only Mr. Nguyen Dinh Can has not yet returned all the land to the commune".
According to document No. 180 of the People's Committee of Quy Chau district dated May 17, 2012 regarding the response to the citizen's request: "The People's Committee of the district has reclaimed 8 hectares out of a total of 10.2 hectares of land from Mr. Can, the remaining 2 hectares, when Mr. Can's family finishes harvesting acacia, the land will be returned to the State". However, Mr. Hong said that up to this point, the locality has not received a document on land handover for Mr. Can's forestry land. And what makes people upset is that currently some of Mr. Can's acacia areas are over 10 years old, but have not been harvested.
Not only that, in 2012, Mr. Can continued to plant new acacia forest on forest land that was wrongly granted to the subject that had been decided to be recovered. Thus, currently on Mr. Can's land there are 4 generations of forest: 1 year old, 2 years old, 4 years old and 10 years old. For that reason, the people of Hanh Tien village believe that Mr. Can is deliberately delaying and refusing to hand over the land to the locality.

Regarding the areas that the District People's Committee has reclaimed from individuals who have allocated land to the wrong subjects, Mr. Hong said: "Because the locality did not organize land division for the people, people competed with each other, did whatever they wanted, spontaneously planted forests and sugarcane, very chaotic."
Regarding the issue of land allocation for production, Mr. Sam Van Thiet - Chairman of Chau Hanh Commune People's Committee said: "The reason why the locality has not yet organized land allocation for the people is because the people have not registered to receive forestry land. In July 2012, the Commune People's Committee notified all villages in the commune that if any household needs forestry land for production, they should register with the locality, but up to now the commune has not received any registration from the people. However, to implement land allocation for production, funding is needed. This is beyond the capacity of the locality."
Talking to us, Mr. Nguyen Duy Hong - Head of the Department of Natural Resources and Environment of Quy Chau district, said: "Regarding the cases of granting forestry land to the wrong subjects in the Ban stream area of Chau Hoi and Chau Hanh communes according to Decree 163/1999/ND-CP, there are still 5 individuals who have not handed over the land to the locality for management, including Mr. Vo Van Hong, Tran Van My, Vi Van Ky, Nguyen Dinh Can and Mr. Be. The reason is that these cases have not yet harvested all the assets on the land. The reason the district has not organized the measurement to divide the land for people to produce is due to lack of funds. In the past, the locality organized the division of land for people by manual means". However, when we mentioned this issue to Mr. Tran Nguyen Hong (Pho Ban Hanh Tien) and Mr. Sam Van Thiet (Chairman of the People's Committee of Chau Hanh commune), there was no such thing as dividing land for people by any means.
Directly meet Mr. Nguyen Dinh Can to discuss why he has not yet handed over the land to the State? Mr. Can said that in the past, some people in Hanh Tien village have fought over his land for production, and currently he only manages the raw material forest on the land. When the family has harvested all of its assets, the land will be handed over to the locality. But when asked "Why in 2012 did you continue to plant new acacia areas on forestry land that was wrongly granted to subjects that had been decided to be recovered?" After a while of beating around the bush, Mr. Can admitted that doing so was wrong. From this specific case, it can be seen that if the People's Committee of Quy Chau district does not resolutely implement measures to recover forestry land that was wrongly granted to subjects according to Decision No. 598, it will lead to a situation where some subjects use the trick of "throwing mud into the pond", continuing to profit from the wrongly granted forest land area.
After 5 years of the decision (June 29, 2007), Quy Chau has not yet recovered all the land area of the above subjects. Meanwhile, people are still waiting for land allocation to produce and stabilize their lives.
On July 17, 2006, the People's Committee of Nghe An province established an inspection team on land and forest allocation in Quy Chau district. On March 23, 2007, the People's Committee of Nghe An province concluded on the above issue. According to the conclusion, the People's Committee of Quy Chau district allocated land and issued certificates of forest land use rights to 18 non-agricultural households, not residing in the locality (most of whom were district leaders at that time and had permanent residence in Quy Chau town, now Tan Lac town). These are households and individuals who are not eligible for land allocation according to Decree 163/1999/ND-CP of the Government. Therefore, the People's Committee of the province requested the People's Committee of Quy Chau district to recover the above 18 plots of land and put them into the forestry land fund to allocate to households and individuals in need or for lease, ensuring the conditions according to the provisions of law.
