PV:How do you evaluate the handling of party members who have violated the law in recent times?

Mr. Tran Ngoc Duong: In recent times, especially after the 4th Central Conference, the Party has paid great attention to and taken strong action in dealing with party members and officials, especially in cases of corruption, causing loss, waste, and damage in state-owned enterprises.

The actions that are increasingly supported and agreed upon by the people demonstrate the strength and determination of our Party and State in the fight against corruption. If this trend continues, the people's trust will increase day by day.

PV: Recently, the Politburo issued Regulation 102 on disciplinary action against violating party members. According to you, what is the role and significance of this Regulation in the work of inspection, supervision and disciplinary action against violating party members?

Mr. Tran Ngoc Duong: Regulation 102 on handling party members, in my opinion, is a set of laws in the organization and operation of the Party. Besides the State, there are laws on administrative sanctions or the Criminal Code, but within the Party, party members who have strived their whole lives to follow the Party's ideals and operate in a Party organization also have their own laws.

Regulation 102 represents the ideology of a rule-of-law State in the Party's organization. It is the basis and support for handling violations.

PV:Previously, Party disciplinary regulations did not raise the issue of statute of limitations. However, with Regulation 102, for the first time, a statute of limitations is set forth. In your opinion, what impact will this have?

Mr. Tran Ngoc Duong: The statute of limitations is a concept of legal science. If an illegal act is brought to light after the statute of limitations has expired, it is unethical and inhumane. And in fact, bringing it to light after the statute of limitations has expired will not have any good deterrent or educational effect.

I think Regulation 102 is very progressive. The statute of limitations for handling party discipline is clearly defined for different acts, such as: 5 years for violations that require disciplinary action in the form of reprimand...

Mr. Tran Ngoc Duong:Dismissal would be more accurate than dismissal. Because there are many cases of dismissal, such as resigning from one position to hold another; or someone resigns from their position for health reasons, not because of disciplinary action.

As for discipline, dismissal is the true nature of the form of discipline, there is no form of discipline that is to remove someone from office.

PV:In the face of the Party's regulations that are considered very specific and detailed, there are still some public opinions that they are too strict. Do you think this is necessary strictness and rigor?

Mr. Tran Ngoc Duong:In the context of moral degradation of cadres, the state of self-evolution and self-transformation, these regulations are very strict, detailed, specific, and have the effect of limiting behaviors from the smallest to the largest ones to stay within the framework. If you have joined a political organization, especially the Party organization, you must comply.

PV: To do this, how should it be implemented to achieve the highest efficiency, sir?

Mr. Tran Ngoc Duong:Party members must first know and master Regulation 102. It is advisable to organize a study session for cadres and party members on Regulation 102. When cadres and party members understand it clearly, they will voluntarily comply.

After understanding, the issue of handling these violations is extremely important. Handling them without proportion, transparency, and fairness is also a factor that nullifies these regulations.
