New regulations on management mechanism and organization of implementation of national target programs

The Government has just issued Decree No. 38/2023/ND-CP dated June 24, 2023 amending and supplementing a number of articles of Decree No. 27/2022/ND-CP stipulating the management mechanism and organization of implementation of national target programs.

Decree amending and supplementing regulations on "Establishing and assigning plans for national target programs for the 5-year period of the country" (Article 5) as follows:

The establishment, appraisal, decision on investment policy and decision on investment in national target programs shall comply with the provisions of the Law on Public Investment.

The planning of the national 5-year target program is carried out after the Prime Minister approves the decision to invest in the national target program; stipulates the principles, criteria, and norms for allocating central budget capital and the proportion of counterpart capital from local budgets to implement the national target program.

Within 15 working days from the date the Prime Minister issues regulations on principles, criteria, and norms for allocating central budget capital and the proportion of counterpart capital from local budgets to implement national target programs, the program owner shall preside over and coordinate with the component project owners and relevant agencies.

Projecting the objectives, tasks and allocation plan for the medium-term public investment plan from the central budget for the 5-year period of the national target program for ministries, central agencies and provinces and centrally run cities; proposing key solutions to implement the national target program for the 5-year period, and sending them to the Ministry of Planning and Investment and the Ministry of Finance.

Develop a plan to allocate and announce the expected level of central budget capital for the 5-year period; annually announce the level of central budget capital for the 3-year period of the national target program to ministries, central agencies, provinces and centrally run cities.

The Ministry of Planning and Investment shall preside over the synthesis and report to the Prime Minister on the assignment of objectives and tasks for the 5-year period of each national target program to the provinces and centrally run cities. Synthesize and report to competent authorities on the allocation plan and assignment of the medium-term public investment plan from the central budget for the 5-year period of each national target program to ministries, central agencies and provinces and centrally run cities in accordance with the provisions of the Law on Public Investment.

Principles of management of production development support activities under national target programs

The Decree also amends and supplements the "Principles for managing production development support activities under the national target program" (Article 20).

Accordingly, support from the state budget for production development activities is conditional support; the support period is according to the production cycle or the investment period of the national target program. Priority is given to using the state budget to support projects, plans, schemes, and production development models implemented in poor districts, particularly disadvantaged communes in coastal and island areas, and particularly disadvantaged communes and villages in ethnic minority and mountainous areas.

The cost of selecting projects and models to support production development (including the cost of surveying and evaluating; establishing a project and model selection council; selecting ordering units and assigning tasks; organizing bidding to select units providing products and services; appraising prices in plans for purchasing materials, goods and services) is included in the budget for implementing production development support activities or the regular budget of the agency or unit directly implementing production development support activities; not exceeding 5% of the total budget allocated to implement production development support activities.

Priority is given to the use of plant varieties, livestock and other goods and services directly produced by local people in the project implementation area. The unit price for purchasing products, goods and services is calculated according to the market price in the area at the same time, confirmed by the People's Committee at the commune level on the purchase receipt with the local people.

Projects, plans, schemes, and models (collectively referred to as projects) for production development must ensure that at least 50% of people participating in the project are beneficiaries of national target programs, with priority given to resources to support project implementation where over 70% of people participating in the project are poor households, near-poor households, newly escaped poverty households, ethnic minority households, people with revolutionary contributions, and women from poor households.

Payment and settlement of state budget capital for production development support activities based on the results of acceptance of completed work volume according to progress each year or stage.

Support the development of production linked to the value chain

According to the Decree, the conditions for supporting the development of value chain-linked production are: The project and link plan must determine the results of the employment index, income increase, and contribution to local socio-economic development according to the annual plan and the project completion time. The unit in charge of the link and the linked subjects must have a contract or cooperation record on training, technical support, supply of input materials and services, production organization, harvesting, preliminary processing, processing, purchasing, and product consumption.

The content of support from the state budget capital to implement national target programs is in accordance with the guidance of the program management agency in accordance with each national target program. Priority is given to the implementation of the following contents to support the linked subjects: Training in production techniques; training in management skills, contract management capacity, chain management and market development. Transferring and applying new science and technology, applying technical processes in production and synchronous quality management along the chain. Materials and equipment for production, service provision, plant and animal varieties. Promoting and promoting trade for products, goods and services.

Level of support and method of support from state budget capital: Maximum support shall not exceed 80% of the total cost of implementing a project or association plan in a particularly difficult area; not exceed 70% of the total cost of implementing a project or association plan in a difficult area; not exceed 50% of the total cost of implementing a project or association plan in another area within the investment scope of national target programs.
