Comprehensive regulations on supervisory activities of the National Assembly and People's Councils

Continuing the 34th session, on the afternoon of January 19, the National Assembly Standing Committee gave opinions on the project to summarize, review, propose amendments, supplements, and promulgate new legal documents related to the organization and operation of the National Assembly, National Assembly agencies, National Assembly deputies and National Assembly delegations, and the draft Law on supervisory activities of the National Assembly and People's Councils.

Comprehensively amend and supplement the system of legal documents to specify regulations on the organization and operation of the National Assembly.

The report on the Project to summarize, review, propose amendments, supplements and promulgate new legal documents related to the organization and operation of the National Assembly, National Assembly agencies, National Assembly deputies and National Assembly delegations clearly states the objective of the Project to prepare for the comprehensive study and amendment of the system of legal documents to specify the regulations on the organization and operation of the National Assembly (in the Law on the Organization of the National Assembly).

The project focuses on solving the problems of summarizing the implementation of legal documents related to the activities of the National Assembly, National Assembly agencies, National Assembly deputies and National Assembly delegations to see the results achieved, the shortcomings, limitations and difficulties, and obstacles in the process of implementing the regulations and rules, thereby proposing amendments and supplements to necessary contents.

Review all relevant regulations, statutes and resolutions to see which contents have been codified in the 2014 Law on Organization of the National Assembly or will continue to be codified in the Law on Supervisory Activities (amended), the Law on Promulgation of Legal Documents (amended) and other laws expected to be submitted to the National Assembly for approval in 2015; which contents are no longer consistent with the Constitution and current laws; which contents need to be amended, supplemented, abolished or newly issued to suit the current operations of the National Assembly. Thereby, it is recommended to submit to the National Assembly Standing Committee a list of documents that need to be amended, supplemented, newly issued or abolished and directions for amending and supplementing those documents to report to the National Assembly to add to the Program for building laws, ordinances and resolutions of the National Assembly and the National Assembly Standing Committee in 2015 to ensure the implementation of the Law on the Organization of the National Assembly, which will take effect from January 1, 2016.

The contents of the Project include summarizing the implementation of legal documents related to the activities of the National Assembly, National Assembly agencies, National Assembly deputies and National Assembly delegations; on the legalization of regulations in internal rules, regulations, and resolutions; Proposing documents that need to be amended, supplemented, abolished, or newly issued.

Commenting on the Report, Vice Chairwoman of the National Assembly Tong Thi Phong suggested strengthening coordination between relevant agencies in reviewing all regulations in internal rules, regulations, and related resolutions, thereby proposing a list of documents that need to be amended, supplemented, newly issued, or abolished, and directions for amendments and supplements.

Chairman of the National Assembly Council K'sor Phuoc suggested that it is necessary to increase the initiative of the National Assembly Council and the National Assembly Committees in summarizing the implementation, reviewing and proposing amendments and supplements to the Regulations on the operation of the National Assembly Council and the National Assembly Committees. The delegate suggested that it is necessary to specify the roles and responsibilities of National Assembly deputies as well as the National Assembly delegations in participating in this Project.

Giving first comments on the draft Law on supervisory activities of the National Assembly and People's Councils

During the remaining time of this afternoon's working session, the National Assembly Standing Committee discussed major issues of the draft Law on Supervisory Activities of the National Assembly and People's Councils.

The submission of the draft Law on Supervisory Activities of the National Assembly and People's Councils clearly states that the draft Law is built to ensure the institutionalization of the Party's policies and guidelines, concretization of the Constitution (2013) and consistency in the legal system regulating the organization of the state apparatus related to the supervisory activities of the National Assembly and People's Councils.

Innovation in the supervisory activities of the National Assembly and People's Councils must be carried out synchronously and in accordance with innovations in the organizational structure of the National Assembly, People's Councils as well as other agencies in the state apparatus.

Supervision activities must ensure that they do not affect the operations of the agencies, organizations and individuals subject to supervision, contribute to improving the quality of operations of the agencies, organizations and individuals subject to supervision, and ensure the effectiveness and efficiency of operations of state agencies from central to local levels.

The draft Law scientifically and reasonably defines the specific subjects, scope and authority of supervision of the National Assembly and People's Councils, helping to avoid overlaps and duplications, promoting the role of each supervisory entity; building a supervision implementation process suitable for each supervisory activity of the entities, ensuring the rights and responsibilities of the supervisory entity and the subject of supervision...

The Draft Law on Supervisory Activities of the National Assembly and People's Councils is built on the basis of amending and supplementing the provisions of the Law on Supervisory Activities of the National Assembly (2003) and Chapter III of the Law on Organization of People's Councils and People's Committees (2003) and other provisions related to the supervisory activities of the National Assembly and People's Councils. This is a project that comprehensively regulates the supervisory activities of the National Assembly and People's Councils. The Draft Law consists of 4 chapters and 83 articles.

Giving initial comments on the draft Law, many opinions in the National Assembly Standing Committee assessed that the draft Law had been actively and carefully prepared on the basis of amending and supplementing the provisions of the Law on Supervisory Activities of the National Assembly (2003) and Chapter III of the Law on Organization of People's Councils and People's Committees (2003) and other provisions related to supervisory activities of the National Assembly and People's Councils.

Assessing this as an important Law project because supervision is one of the three important functions of the National Assembly, Vice Chairwoman of the National Assembly Nguyen Thi Kim Ngan suggested that the drafting committee of the Law project should clarify the concept of supreme supervision; how it is different from other supervisions in terms of effectiveness, scope, subjects...

Vice Chairwoman of the National Assembly Nguyen Thi Kim Ngan said that in order to ensure the effectiveness and efficiency of supervision activities, the draft Law needs to supplement a number of regulations. The Vice Chairwoman of the National Assembly assessed that the draft Law only lists the forms of supervision, and still has many regulations that are not sufficient to ensure the effectiveness and efficiency of supervision activities.

Chairman of the Ethnic Council K'sor Phuoc asked the Drafting Committee to let him know whether the draft Law has overcome the formality in monitoring activities?

National Assembly Chairman Nguyen Sinh Hung suggested that the drafting committee should shorten the draft Law, focusing on the effectiveness of monitoring activities.
