(Baonghean) - Question: How is compensation for land and remaining land investment costs when the State reclaims agricultural land from households and individuals regulated in the 2013 revised Land Law?

Reply:Article 77 of the 2013 amended Land Law stipulates compensation for land and remaining land investment costs when the State reclaims agricultural land from households and individuals as follows:

1. Households and individuals using agricultural land when the State reclaims land will be compensated for land and remaining investment costs on land according to the following provisions:

a) The area of ​​agricultural land to be compensated includes the area ofThe limit prescribed in Article 129 and Article 130 of this Law and the land area received by inheritance;

b) For agricultural land areas exceeding the limit prescribed in Article 129 of this Law, no land compensation shall be provided but compensation shall be provided for investment costs in the remaining land;

c) For agricultural land areas that have been transferred land use rights exceeding the limit before the effective date of this Law, compensation and support shall be implemented according to Government regulations.

2. For agricultural land used before July 1, 2004, where the land users are households or individuals directly engaged in agricultural production but do not have a certificate or do not meet the conditions for being granted a certificate of land use rights, house ownership rights and other assets attached to land according to the provisions of this law, compensation shall be made for the actual land area in use, the area to be compensated shall not exceed the agricultural land allocation limit prescribed in Article 129 of this law.
