Regulations on granting Land Use Right Certificates for land for construction of urban areas and rural residential areas
Mr. NXD in Dien Chau district asked: How is the issuance of Certificates of land use rights and ownership of assets attached to land for land used for construction of urban areas, rural residential areas, production and business projects with many different land use purposes regulated?
Article 143 of the 2024 Land Law stipulates as follows:
1. Land allocated to investors to implement urban and rural residential area construction projects in which the project identifies many construction items or many land areas with different land use purposes as prescribed in Article 9 of this Law, the location and area must be clearly determined for each land use purpose and a Certificate of land use rights and ownership of assets attached to the land must be issued as follows:

a) The issuance of Certificates of land use rights and ownership of assets attached to land is carried out for each land plot used for each purpose, in accordance with the detailed construction planning approved by the competent authority;
b) For the land area used for the purpose of constructing public works serving the common interests of the community inside and outside urban areas and rural residential areas according to the investment project and detailed construction planning approved by competent authorities, it shall be handed over to the locality for management without granting a Certificate of land use rights and ownership of assets attached to the land;
c) In case of apartments combined with offices, commercial and service establishments, if the investor has the need and meets the conditions, he/she will be granted a Certificate of land use rights and ownership of assets attached to the land for one or more apartments, offices, commercial and service establishments owned by the investor.
2. Land allocated to investors for the implementation of production and business projects including many land areas with different purposes of use shall be granted a Certificate of land use rights and ownership of assets attached to land to the investor for the entire land area, clearly stating the location and land area of each land use purpose as prescribed in Article 9 of this Law. In case the investor has a need, a Certificate of land use rights and ownership of assets attached to land shall be granted for each land plot according to each purpose of use, in accordance with the approved detailed construction plan.
