Regulations on vocational training support when the state acquires land

Question: Regulations on support for training, career conversion and job search in cases where the State reclaims agricultural land from households and individuals directly engaged in agricultural production?

Reply:According to Article 20 of Decree No. 47/2014/ND-CP:

1.Households and individuals directly engaged in agricultural production specified in Points a, b, c and d, Clause 1, Article 19 of this Decree (except for households and individuals who are officials, employees of state-owned farms and state-owned forestry farms who have retired, have lost their ability to work, or have quit their jobs and are entitled to benefits) when the State recovers agricultural land and is compensated in cash, in addition to receiving compensation in cash for the recovered agricultural land area, they are also supported with training, job conversion and job search according to the following provisions:

a)Cash support is not more than 5 times the price of agricultural land of the same type in the local land price list for the entire area of ​​recovered agricultural land; the supported area does not exceed the local agricultural land allocation limit;

b)The specific support level is determined by the Provincial People's Committee based on local conditions.

2. The Ministry of Labor, War Invalids and Social Affairs shall preside over and coordinate with relevant ministries and branches to submit to the Prime Minister for decision on mechanisms and policies for job creation and vocational training for people whose agricultural land is recovered.

3.The provincial People's Committee, based on the employment mechanism and policy decided by the Prime Minister, directs the preparation and implementation of training, job conversion and job search plans for people of working age in the locality. The training, job conversion and job search plan is prepared and approved at the same time as the compensation, support and resettlement plan. In the process of preparing the training, job conversion and job search plan, the opinions of the land-recovering people must be sought.
