Regulations on what party members are not allowed to do

The Central Executive Committee has issued Regulation No. 47-QD/TW on what Party members are not allowed to do. Here is the full text of this regulation:

- Pursuant to the Party Charter;

- Pursuant to the Constitution and laws of the Socialist Republic of VietnamMale;

- Pursuant to the Working Regulations of the Central Executive Committee, the Politburo and the Secretariat of the 11th tenure;

- To strengthen Party discipline and maintain political qualities, revolutionary ethics, and exemplary vanguard character of Party members, and to improve the leadership capacity and fighting strength of Party organizations,

CENTRAL EXECUTIVE COMMITTEE REGULATIONS

Members of the Communist Party of Vietnam are revolutionary soldiers in the vanguard of the working class, working people and Vietnamese nation; along with exemplary compliance with the Political Platform, Party Statutes, resolutions and directives of the Party and the laws of the State, regulations of the Fatherland Front and socio-political organizations of which they are members, they must strictly comply with specific regulations of the Party on what Party members are not allowed to do.

I- Things party members are not allowed to do

1 - Speaking, acting against or failing to implement the Political Platform, Party Charter, resolutions, directives, regulations, decisions, and conclusions of the Party; doing things that are not permitted by law.

2 - Providing, revealing, losing or writing articles, posting secret information and documents of the Party and State or matters not yet permitted to be published; storing, propagating, disseminating or inciting others to propagate and disseminate information and documents in any form to spread views contrary to the Party's guidelines and the State's laws.

3 - Writing and publishing false, slanderous, fabricated news or articles or attributing crimes or sentences before trial, not posting feedback or corrections as prescribed. Composing, producing, storing, and distributing unhealthy literary and artistic works or projects that are provocative and have a negative impact on society; distributing untrue articles and memoirs.

4 - Organizing, inciting, and participating in factional, divisive, and local activities that cause internal disunity. Taking advantage of speaking out, in the name of reflecting and giving opinions to the Party, to attack, slander, insult, make arbitrary comments and assessments of others. Threatening, persecuting, and taking revenge on those who make accusations, criticize, and give opinions.

5 - Making fabricated accusations; writing anonymous or fake accusations. Writing and signing a complaint with others. Organizing or participating in inciting, inciting, bribing, or forcing others to make complaints or accusations.

Intentionally sending or distributing complaints and denunciations to places without authority to resolve them.

6 - Organizing and participating in illegal associations; demonstrating and gathering in large numbers causing insecurity and disorder.

7 - Party members (including Party committee members and Party members who are cadres under the management of Party committees and Standing Committees of Party committees) run for election, accept nominations, and nominate positions of state organizations, the Fatherland Front, and socio-political organizations (which must be introduced by the Party organization according to regulations) without permission from the competent Party organization.

8 - Bureaucracy, lack of responsibility, cover-up, false reporting, abuse of power, harassment in performing duties.

Lack of responsibility allows disunity, corruption, smuggling, waste, loss of assets and other negative phenomena to occur in the agencies, units and localities under one's direct charge.

Having behavior of letting father, mother, wife (husband), children, brothers, sisters, or siblings carry out projects or do business in fields or units under one's direct responsibility that are contrary to regulations.

Knowing but not reporting, reflecting, and handling acts of corruption; not implementing regulations on protecting people against corruption.

9 - Violating regulations in the following matters: management of houses, land, assets, capital, and finances of the Party and the State; capital mobilization and credit lending; project appraisal, approval, and bidding; implementation of social security, relief, and rescue policies; inspection, auditing, and regulations in litigation activities.

10 - Interfering or influencing organizations or individuals so that they or others can be appointed, nominated, run for election, study, or go abroad in violation of regulations.

Taking advantage of assigned position to appropriate, borrow, or lend money or property of the direct management subject in violation of regulations.

Coercing or bribing individuals or organizations to cover up or reduce the crime of others.

11 - Presiding over, advising, proposing, and participating in the issuance of documents that are against regulations. Creating conditions or engaging in behavior that allows parents, spouses, children, siblings to take advantage of their positions and work positions for personal gain.

12 - Giving, receiving, or brokering bribes; brokering administrative procedures or taking advantage of a work position to broker remuneration in any form contrary to regulations. Giving, receiving commissions or brokering the giving or receiving of commissions contrary to regulations.

13 - Reporting, making false records, declaring personal history and background; declaring assets and income not in accordance with regulations; opening overseas accounts in violation of regulations; participating in money laundering activities.

14 - Organizing tours, giving gifts, or entertainment to take advantage of responsible people, leading to the issuance of wrong decisions that benefit oneself or the organization, agency, or business in which one participates.

15 - Using public funds to visit, receive guests, give gifts, construct works, purchase equipment, means of work, travel, and communication exceeding standards, norms, or against regulations.

Occupying, leasing, lending assets, lending funds of the State, agencies, units, and organizations assigned to manage and use them in violation of regulations.

16 - Personally or by letting one's parents, spouse, children, siblings travel, visit, study, or receive medical treatment domestically or internationally with funding from domestic organizations or foreign organizations or individuals without permission from a competent authority.

17 - Organizing or participating in gambling in any form; lending money in violation of the law; using drugs; drinking alcohol to the point of drunkenness and other social evils.

Violating professional ethics; committing acts of domestic violence, violating population policy and family planning, living with another person as husband and wife; marrying a foreigner against regulations or letting one's children marry a foreigner.

18 - Superstition, superstitious activities (burning votive offerings, practicing as mediums, shamans, fortune tellers). Establishing temples, shrines, and places of worship of illegal religions; supporting or participating in illegal religions; participating in organizations established by religions that have not been approved by competent authorities. Taking advantage of beliefs for personal gain.

19 - Organizing weddings, funerals, holidays, birthdays, wedding anniversaries; celebrating longevity, new house, promotions, job transfers in a lavish, wasteful or profit-making manner.

II-Organization of implementation and handling of violations

1 - The Central Inspection Commission is assigned to guide the implementation of this regulation and assist the Central Executive Committee, the Politburo, and the Secretariat in inspecting and supervising the implementation.

Party committees at all levels are responsible for leading, directing, and organizing the implementation of the regulations and periodically reporting annually to higher-level Party committees on the implementation of the regulations through the inspection committee of the higher-level Party committees.

During the implementation process, if there are any issues that need to be supplemented or revised, they must be reported to the Central Executive Committee for consideration and decision.

2 - Party members who violate this Regulation must be handled fairly, accurately, and promptly according to Party regulations and State laws.

3 - This regulation replaces Regulation No. 115 - QD/TW, dated December 7, 2007 of the Politburo (10th tenure) on things that party members are not allowed to do, effective from the date of signing and dissemination to party cells for implementation.
