Regulations on salary arrangement for newly recruited and accepted civil servants
Circular 05/2024/TT-BNV of the Minister of Home Affairs clearly stipulates salary classification for those recruited and accepted as civil servants from December 7, 2023.

Salary arrangement for recruited and accepted civil servants from December 7, 2023
1- In case of salary arrangement according to the State's prescribed salary tables, salary arrangement corresponding to each case of recruitment and acceptance into civil servants is carried out as follows:
+ In case of salary arrangement according to the professional and technical salary table of civil servants or public employees prescribed in Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces (amended and supplemented in Decree No. 76/2009/ND-CP dated September 15, 2009, Decree No. 14/2012/ND-CP dated March 7, 2012, Decree No. 17/2013/ND-CP dated February 19, 2013 and Decree No. 117/2016/ND-CP dated July 21, 2016), follow the instructions in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding salary arrangement when upgrading ranks, transfer of ranks and types of civil servants and public employees;
+ In case of salary being arranged according to the salary table of military ranks of people's army officers; officers, non-commissioned officers of people's police and cipher officers or salary being arranged according to the salary table of professional soldiers of people's army and technical specialists of people's police or according to the salary tables for people doing cipher work, then follow the instructions in Clause 6, Clause 7, Section III of Circular No. 79/2005/TT-BNV dated August 10, 2005 of the Minister of Home Affairs guiding salary transfer for cadres, civil servants and public employees when changing jobs and cases of being transferred from the armed forces, cipher officers and state-owned companies to work in state agencies and state-owned service units;
+ In case the person holding a title or position at a state-owned enterprise is classified according to the salary coefficient of a full-time company manager as prescribed in Decree No. 52/2016/ND-CP dated June 13, 2016 of the Government regulating salaries, remunerations, and bonuses for managers of single-member limited liability companies in which the State holds 100% of the charter capital, the instructions in Circular No. 13/2018/TT-BNV dated October 19, 2018 of the Minister of Home Affairs amending Clause 8, Section III of Circular No. 79/2005/TT-BNV shall be implemented according to the instructions in Circular No. 13/2018/TT-BNV dated October 19, 2018 of the Minister of Home Affairs amending Clause 8, Section III of Circular No. 79/2005/TT-BNV.
2- In case the salary has been arranged according to the salary tables prescribed by the State, then transferred to the private sector (not yet received one-time social insurance benefits) and has a working period with compulsory social insurance payment, the salary arrangement corresponding to each case of recruitment and acceptance into civil servants is carried out as follows:
Based on the salary coefficient at the time of transfer to the private sector, the transfer is made according to the provisions of Section 1 above and the working time with compulsory social insurance after transfer to work in the private sector is calculated after every 03 years (full 36 months), for the case of being appointed to the position of civil servant with salary grade A0 or higher or after every 02 years (full 24 months), for the case of being appointed to the position of civil servant with salary grade B, the position is promoted by 01 salary level or seniority allowance beyond the framework (if any); the number of months less than 36 months (for civil servants with salary grade A0 or higher) or less than 24 months (for civil servants with salary grade B) remaining is counted as the time to consider raising the salary grade next time or considering enjoying seniority allowance beyond the framework (if any).
3- In case of working time that is subject to salary with compulsory social insurance payment in accordance with the provisions of law and not subject to the provisions in sections 1 and 2 above, salary classification and determination of equivalent time to hold the rank of civil servant appointed upon recruitment and acceptance shall be carried out as follows:
+ About salary classification:
Based on the total period of receiving salary with compulsory social insurance payment (if there is a non-continuous period without receiving one-time social insurance benefits, it will be accumulated) minus the probationary period calculated according to the regulations of the professional title appointed when recruiting and receiving, the remaining time is the basis for salary classification in the professional title recruited and received as follows: Calculated from level 1 of the professional title of the civil servant appointed when recruiting and receiving, after each period of 03 years (full 36 months) for the case of being appointed to the civil servant position with salary class A0, type A1 or after each period of 02 years (full 24 months) for the case of being appointed to the civil servant position with salary class B, the salary will be ranked up 1 level.
After converting the time to be classified into the salary grade in the professional title appointed upon recruitment and acceptance as mentioned above, if the number of months is less than 36 months (for civil servants with salary grade A0, A1) or less than 24 months (for civil servants with salary grade B), then this number of months will be counted towards the time to consider raising the salary grade next time, or considering receiving seniority allowance exceeding the framework (if any) in the title appointed upon recruitment and acceptance.
+ Regarding determining the equivalent time to hold the rank of appointed civil servants when recruiting and receiving:
In case the working time is subject to salary with compulsory social insurance payment in accordance with the provisions of law and is calculated to classify the salary into the rank of the appointed civil servant when recruiting and receiving as prescribed in this clause, the equivalent time holding the rank of the appointed civil servant is calculated from the date of having the same training level, or having a higher training level than the training level required by the job position being recruited and received.
4- In cases of recruitment, acceptance into civil service and salary classification according to the provisions in sections 1 and 2 above, if during the previous working period, there is a year of work that is evaluated and classified as not completing the task or being disciplined without having the salary increase period extended according to regulations, the time will not be counted for salary classification according to the provisions in Clause 3, Article 2 of Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Minister of Home Affairs guiding the implementation of the regular salary increase regime and early salary increase for cadres, civil servants, public employees and workers (amended in Clause 5, Article 1 of Circular No. 03/2021/TT-BNV dated June 29, 2021 of the Minister of Home Affairs).
The Circular clearly states that in case the decision on admission and recruitment is issued from December 7, 2023 onwards, the time to enjoy and the time to consider raising the salary grade for the next time will be calculated from the date of the decision on salary classification upon recruitment and reception by the competent authority. The salary classification according to this Circular does not apply to cases where civil servants are considered for a change in professional title rank according to the provisions of specialized laws.
The Circular takes effect from August 15, 2024.
