Regulations on penalties for violations of chemicals and explosives

The Government has just issued Decree No. 163/2013/ND-CP dated November 12, 2013, regulating administrative sanctions for violations in the field of chemicals, fertilizers and industrial explosives.

Subjects subject to administrative sanctions are Vietnamese individuals and organizations that commit administrative violations in the field of chemicals, fertilizers and industrial explosives in the territory of the Socialist Republic of Vietnam; foreign individuals and organizations that commit administrative violations in the field of chemicals, fertilizers and industrial explosives in the territory of Vietnam, except in cases where international treaties to which Vietnam is a member have other provisions.

The level of fines and the authority to impose fines on individuals and organizations are specifically regulated as the maximum fine in the chemical sector prescribed in Chapter II of this Decree applicable to individuals is 50 million VND. The fine for the same administrative violation of an organization is twice the fine for an individual.

The maximum fine in the field of fertilizers and industrial explosives prescribed in Chapter III and Chapter IV of this Decree, applicable to individuals, is 100 million VND. The fine for the same administrative violation committed by an organization is twice the fine for an individual.

The Decree takes effect from December 31, 2013. This Decree replaces Decree No. 90/2009/ND-CP dated October 20, 2009 of the Government regulating administrative sanctions for violations in chemical activities; replaces Decree No. 15/2010/ND-CP dated March 1, 2010 of the Government regulating administrative sanctions for violations in fertilizer production and trading activities; replaces Section 2, Chapter V of Decree No. 100/2005/ND-CP dated August 3, 2005 of the Government on the implementation of the Convention on the Prohibition of the Development, Production, Stockpiling, Use and Destruction of Chemical Weapons; replaces Decree No. 64/2005/ND-CP dated May 16, 2005 of the Government regulating administrative sanctions for violations in the field of industrial explosives management./.
