National sovereignty and jurisdiction

(Baonghean.vn) -Question 22: What are national sovereignty and jurisdiction?

Reply:According to the international legal perspective, sovereignty is a separate right of a nation that is exercised within the exclusive economic zone and continental shelf. This is a right originating from territorial sovereignty, of a sovereign nature. Meanwhile, jurisdiction is a consequence of sovereignty and sovereign rights, which has a complementary effect in creating an environment for the exercise of sovereignty and sovereign rights. Thus, jurisdiction is closely linked to the national territory. However, jurisdiction can also be exercised in places where that nation does not have sovereignty. For example, jurisdiction can be applied to ships and means of transport flying the flag of that nation when they are operating in the waters under the sovereignty and sovereign rights of another nation. Jurisdiction in a broad sense includes:

- Authority to make decisions and regulations;

- Authority to supervise implementation;

- The court's jurisdiction over a particular area; in a narrow sense, it is the court's legal authority to try a person or a matter.
