Powers and responsibilities of Traffic Police from January 1, 2025

Accordingly, Circular No. 69/2024/TT-BCA on requirements, standards, tasks, powers, responsibilities, equipment, means, weapons, support tools, principles, forms in commanding and controlling road traffic; assignment and decentralization in commanding and controlling road traffic; management, operation, and exploitation of road traffic light systems; use of smart devices to support commanding and controlling road traffic; order of commanding and controlling road traffic; handling of a number of specific cases while performing the task of commanding and controlling road traffic of traffic police and the responsibilities of other forces assigned to guide traffic on roads.

One of the notable contents in Circular No. 69/2024/TT-BCA is the regulations on the powers and responsibilities of the Traffic Command and Control Police, which will be applied from January 1, 2025.

Specifically, the authority of the Traffic Police to command and control traffic is stipulated as follows:

Temporarily suspend people and vehicles from traveling on certain road sections, re-allocate traffic, re-allocate routes, temporary stopping and parking areas when traffic jams occur or when there are other necessary requirements to ensure security and order.

Within the scope and area assigned to command and control road traffic or according to the plan and order of the competent authority, vehicles may be stopped to check and control people and vehicles violating traffic order and safety according to the provisions of law.

Penalize administrative violations in the fields of road traffic, security, order and other administrative violations in the fields of state management according to the provisions of law; apply measures to prevent and ensure the handling of administrative violations according to the provisions of law.

Requesting agencies, units, organizations and individuals to coordinate and support in resolving accidents, traffic jams, traffic obstructions or other cases causing disorder and disruption of road traffic safety.

Use weapons, support tools, and technical equipment and vehicles according to the provisions of law.

Exercise other powers as prescribed by law.

In addition, Circular No. 69/2024/TT-BCA also stipulates the tasks of the Traffic Command and Control Police as follows:

Implement the direction of the leaders of the Ministry of Public Security; Director of the Traffic Police Department; Director of the Provincial and Municipal Police Departments directly under the Central Government; plan or scheme of the Head of the Traffic Control and Guidance Department of the Traffic Police Department; Head of the Traffic Police Department of the Provincial Public Security; Head of the District, Town, City Police Department of the Province and Municipal Police Department directly under the Central Government.

Command, control traffic, divide traffic flows, routes, prevent and resolve road traffic congestion, coordinate with competent authorities to ensure traffic order and safety on assigned routes and areas according to regulations.

Detect and promptly and strictly handle violations of the law on road traffic order and safety and other violations of the law, ensuring proper order, procedures and authority as prescribed by law.

Protect the scene of road traffic accidents, coordinate the organization of emergency aid for victims and resolve road traffic accidents according to the provisions of law.

Coordinate with units and functional agencies to prevent and combat all types of crimes operating on road traffic routes and road vehicles according to the provisions of law.

Detect loopholes and shortcomings in state management of security and order to recommend to competent authorities to take timely measures to handle and overcome them.

For the Traffic Police, in addition to the prescribed duties and powers, they must be responsible for collecting, analyzing, and evaluating relevant factors to propose solutions to manage road traffic activities to ensure order, safety, and smoothness.
