Old decree "outdated"

Ms. Nguyen Kim Lien - Deputy Director of the Department of Chemicals (Ministry of Industry and Trade) - said: Currently, fertilizer production and trading activities are directly regulated by Decree No. 113/2003/ND-CP of the Government regulating the management, production and trading of fertilizers and Decree No. 191/2007/ND-CP on amending and supplementing a number of articles of Decree No. 113/2003/ND-CP.

However, during the implementation process, these two decrees have shown many limitations.The first, on the conditions for fertilizer production and trading. Currently, the whole country has over 500 production units and over or under 30,000 fertilizer trading units, while fertilizer has not been regulated as a conditional production and trading item. Many small establishments do not have all the necessary conditions, produce poor quality products but are still allowed to participate in production and trading.Monday, on procedures for testing, recognizing and cataloging fertilizers.

To be included in the fertilizer list, businesses must go through 13 different administrative procedures. End rampant production

Based on the above facts, Ms. Nguyen Kim Lien commented that the development and promulgation of a new decree on fertilizer management to replace the above two decrees is extremely necessary. Currently, the Ministry of Industry and Trade has completed the draft Decree on fertilizers and sent it to the Ministry of Justice for appraisal.

This draft is said to have many changes in line with reality such as clearly defining the division of responsibilities in managing this item. Specifically, the Ministry of Industry and Trade is responsible for implementing state management of fertilizers and directly managing the inorganic fertilizer sector. The Ministry of Agriculture and Rural Development is responsible for implementing state management of organic fertilizers and other fertilizers.

Fertilizer production and trading are also regulated as conditional products, ending the current rampant production situation. Both ministries have agreed on regulations on granting fertilizer production licenses, helping to eliminate weak units that do not meet production conditions. Sharing more about this "frustration", Mr. Nguyen Duy Khuyen - General Director of Lam Thao Super Phosphate and Chemical Joint Stock Company - said: There should be specific regulations, requiring fertilizer production enterprises to have laboratories that meet national standards. This measure alone has eliminated most of the substandard fertilizer producers.

Another major change in the new decree on fertilizer testing is: Enterprises with fertilizers will self-test according to the testing standards issued by the Ministry of Agriculture and Rural Development and take responsibility for the testing results. No recognition council will be established and regulations on the list of fertilizers allowed to be produced, traded and used in Vietnam will be removed.MaleThis is a very basic change, helping businesses completely eliminate 13 previously unnecessary administrative procedures.

It is known that the decree has been appraised by the Ministry of Justice and the Ministry of Industry and Trade plans to submit it to the Government for promulgation in September 2013.
