Only include in the 2014 Program projects with clear explanations of the necessity of issuance and applicable objects.

The National Assembly's 2014 law and ordinance making program will be carefully considered. This is the important content presented by Member of the National Assembly Standing Committee, Chairman of the National Assembly's Law Committee Phan Trung Ly at the National Assembly on the morning of May 23 regarding the Report on the National Assembly's 2014 Law and Ordinance Making Program.

Up to now, the National Assembly Standing Committee has received proposals on the 2014 Law and Ordinance Development Program, including: The Government proposed 55 projects, including 53 law projects and 2 ordinance projects. The Supreme People's Procuracy proposed 2 law projects. The Supreme People's Court proposed 3 law projects and 1 ordinance project. The Economic Committee proposed 7 law projects.



Overview of the National Assembly session

National Assembly delegations: Da Nang city proposed 3 draft laws; Soc Trang province proposed 36 draft laws, 2 draft ordinances; Quang Nam province proposed 1 draft law. National Assembly delegates proposed 14 draft laws.

Among the above projects, there are many projects proposed by agencies and National Assembly deputies that overlap. According to the proposals of agencies and individuals, the number of draft laws and ordinances proposed to be included in the 2014 Law and Ordinance Development Program is too large compared to the preparation capacity, as well as the time budget of the submitting agencies, the examining agencies, the National Assembly Standing Committee and the National Assembly's ability to consider and approve.

To ensure the feasibility of the Program and avoid too many adjustments, the consideration and decision to include projects in the 2014 Law and Ordinance Development Program must be carefully considered, clearly defining the necessity, scope, subjects of regulation and basic contents of the project, and the necessary conditions to ensure drafting, commenting and submission for consideration and approval.

The National Assembly Standing Committee believes that the establishment of the 2014 Law and Ordinance Development Program must thoroughly grasp a number of basic orientations: Prioritize the inclusion in the 2014 Program of projects to continue to promptly institutionalize the documents of the 11th National Congress of the Party; resolutions of the Party Central Committee and the Politburo; prioritize the inclusion in the 2014 Program of projects directly related to the provisions of the Constitution; projects serving the economic restructuring and improvement of the investment and business environment.

Only include in the 2014 Program projects that clearly explain the necessity of promulgation, scope of regulation, applicable objects, and basic contents; resolutely do not include in the Program projects that do not meet the conditions prescribed by the Law on promulgation of legal documents.

The inclusion of projects in the 2014 Program must take into account the time budget and actual capabilities of the drafting agency and the reviewing agency to avoid placing too many projects in one agency to ensure the quality and progress of project preparation.

For new projects proposed to be added to the Program for the 13th National Assembly term, they should only be added when absolutely necessary, in line with the Program development orientation mentioned in the Resolution on the Program for law and ordinance development of the 13th National Assembly term, and have been well prepared, fully meeting the conditions prescribed by the Law on Promulgation of Legal Documents.

Do not build a list of preparation programs in the annual law and ordinance development program. For all projects that have been included in the XIII National Assembly's term program but have not been considered or approved, the agencies and organizations assigned to draft and submit must have a plan to actively prepare and, when qualified, propose to the National Assembly and the National Assembly Standing Committee to consider including them in the annual program for comments and approval./.
