Will consider special circumstances and posthumously award the titles of People's Artisan and Meritorious Artisan

The Ministry of Culture, Sports and Tourism has just completed and is collecting comments on the Draft Decree regulating the subjects, standards, processes and procedures for considering and awarding the titles of "People's Artisan" and "Meritorious Artisan" in the field of intangible cultural heritage.

The Draft Decree has raised a content that is receiving much attention, which is to consider special circumstances and posthumously award titles to People's Artists and Meritorious Artists.
After a period of delay due to objective factors, the Drafting Committee of the Ministry of Culture, Sports and Tourism has completed this Draft Decree and is urgently seeking opinions from central and local ministries, branches, and relevant organizations and individuals.


The subjects eligible for this Decree are individuals living in and outside the country who possess, teach and promote the value of intangible cultural heritage in the following fields: Language, writing; Folk literature; Folk performing arts; Social customs and beliefs; Traditional festivals; Folk knowledge. The draft Decree also specifically stipulates the rights and obligations of People's Artisans and Meritorious Artisans (NNND, NNUT); Criteria for considering the title of NNND, NNUT; Council for considering the title of NNND, NNUT and the process, documents and procedures for proposing the title of NNND, NNUT.


In fact, there is an issue that has been raised and attracted public attention for many years: folk artisans who meet the criteria for the title of People's Artist and Meritorious Artist according to the law, but due to old age, poor health or death, will they be considered for special consideration or posthumously awarded the title of People's Artist and Meritorious Artist? The Draft Decree has been designed into two articles to address this public concern. Article 7 of the Draft Decree stipulates special consideration and posthumous awarding: Special consideration of the titles of People's Artist and Meritorious Artist in the following cases: Individuals and excellent artisans who meet the criteria for the title prescribed in Clauses 1, 2, 3, 4, 5 and 6, Article 5 or the criteria prescribed in Clauses 1 and 2, Article 6 of the Decree, have a serious illness or are old, have poor health with confirmation from a medical facility at district level or higher, and do not wait for batch consideration; Individuals who meet the criteria for the title of People's Artist as prescribed in Clauses 1, 2, 3, 4, 5, 6 and 7, Article 5 of this Decree but have not been awarded the title of Meritorious Artist. This point applies within 5 years from the effective date of the Decree.


Clause 2, Article 7 of the Draft Decree also stipulates on posthumous conferment, accordingly, the title of People's Artist and Meritorious Artist shall be posthumously conferred to individuals and Meritorious Artists who meet the criteria for conferring the title as prescribed in Article 5 or Article 6 of this Decree but have died within 5 years before the effective date of this Decree. Article 18 of the Draft Decree stipulates the procedures for special conferment and posthumous conferment: For the cases of special conferment and posthumous conferment as prescribed in Article 7 of this Decree, the Minister of Culture, Sports and Tourism shall decide to establish a Special Conferment Council and a Council for posthumous conferment of the title of People's Artist and Meritorious Artist. The Special Conferment Council and the Posthumous Conferment Council shall complete the dossier and submit it to the Prime Minister (through the Central Emulation and Commendation Committee) for consideration and submission to the President for decision on conferring the title of People's Artist and Meritorious Artist.

Talking to us about these regulations, a member of the Drafting Committee said that after listening to public opinion, experts, researchers as well as a number of relevant ministries and branches, the Drafting Committee proposed to the competent authority to issue these regulations to ensure compliance with the provisions of the law, and at the same time show gratitude to folk artists. However, there are also concerns that the provisions for posthumous awardees, specifically "having died within 5 years before the effective date of the Decree" is too long. In other words, do new artists who died before the Decree takes effect have to wait 5 years? A folk culture researcher said that this regulation is probably unnecessary and should not be set. If nothing changes, the Decree will be issued in 2013.
