How are the number of National Assembly deputies, People's Council deputies, constituencies and voting areas allocated and determined?

+ According to Article 8, Chapter II, the total number of National Assembly deputies nationwide is not more than 500 people. The basis for allocating National Assembly deputies of each province and centrally-run city (such as Nghe An) is at least 3 deputies residing and working in the locality; the number of subsequent deputies is calculated based on the population and characteristics of each locality (it is expected that in the next term, Nghe An will elect 13 National Assembly deputies).

+ The number of People's Council delegates (Article 9 of the Law on People's Council Elections) at each level is determined as follows: People's Council at commune and ward level: if in the lowlands, there are 4,000 people or less, 25 delegates are elected; if there are more than 4,000 people, for every additional 2,000 people, 1 more delegate is elected; if in the mountainous and island areas, from 3,000 to 2,000 people, 25 delegates are elected; if there are more than 3,000 people, for every additional 1,000 people, 1 more delegate is elected; communes with 2,000 to 1,000 people, 19 delegates are elected; if there are less than 1,000 people, 5 delegates are elected. Wards with 8,000 people or less are elected 25 delegates; if there are more than 8,000 people, for every additional 4,000 people, 1 more delegate is elected. The above cases are additionally elected but the total number of People's Council delegates at the commune level shall not exceed 35 delegates.

People's Councils of districts, towns, and provincial cities: if the lowland area has 80,000 people or less, 30 representatives are elected; if there are more than 80,000 people, 1 more representative is elected for every 10,000 people; mountainous and island districts with 40,000 people or less have 30 representatives; if there are more than 40,000 people, 1 more representative is elected for every 5,000 people; towns with 70,000 people or more have 30 representatives; if there are more than 70,000 people, 1 more representative is elected for every 10,000 people... Similarly, at the commune level, the district level can elect more representatives, but the total number cannot exceed 40 representatives.

Provincial People's Council, if it is a lowland province with less than 1 million people, 50 representatives are elected; if it is over 1 million people, 1 representative is elected for every 50,000 people; in mountainous provinces with 500,000 people or more, 50 representatives are elected; if it is over 500,000 people, 1 representative is elected for every 30,000 people, but not more than 85 representatives. Other provinces and centrally run cities (for example, Nghe An, Hanoi) with over 3 million people are elected no more than 95 representatives.

+ According to Article 12 of the Law on Election of National Assembly Deputies: each constituency for electing National Assembly and People's Council deputies is divided into many voting areas; the voting area for electing National Assembly deputies is also the voting area for People's Council deputies at all levels. Each voting area has from 300 to 4,000 voters; in mountainous areas, islands and places with sparse population even if there are less than 300 voters, a voting area can be established. The division of voting areas is decided by the People's Committee at the commune level and approved by the People's Committee at the higher level. People's armed forces units, hospitals, maternity homes, nursing homes... with 50 or more voters can establish separate voting areas.
