(Baonghean) - Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003;Pursuant to Decree No. 92/2009/ND-CP dated October 22, 2009 of the Government on titles, numbers, and certain regimes for cadres, civil servants in communes, wards, and towns and non-professional workers at the commune level and Decree No. 29/2013/ND-CP dated April 8, 2013 of the Government amending and supplementing a number of articles of Decree 92/2009/ND-CP dated October 22, 2009 of the Government;

Considering the proposal of the Provincial People's Committee in Submission No. 8438/TTr-UBND dated November 25, 2013;

Based on the Review Report of the Legal Committee and the opinions of the Provincial People's Council Delegates,

RESOLUTION:

Article 1. Scope of regulation and applicable subjects

This Resolution stipulates the number, titles and allowances for part-time workers in communes, wards, towns, hamlets, blocks and villages in Nghe An province according to Decree No. 29/2013/ND-CP dated April 8, 2013 of the Government on amending and supplementing a number of articles of Decree 92/2009/ND-CP dated October 22, 2009.

Article 2. Number and title

1. Quantity:

a) In communes, wards and towns: Each position is assigned one person. Particularly for communes of type I, type II, communes with complex security, order and national defense issues, no more than 2 deputy police chiefs, 3 permanent police officers, 2 deputy military commanders are assigned. For communes of type I, communes with Catholics accounting for over 20% of the population, communes with ethnic minorities accounting for over 50% of the population, no more than 2 Vice Chairmen of the Fatherland Front Committee are assigned. The total number is not more than 21 people.

b) In hamlets, blocks, and villages: Each position is assigned one person. The total number of people is not more than 5.

2. Title:

a) In communes, wards and towns:

- The general positions include 15 positions: Deputy Chief of Police; Deputy Military Commander; Vice Chairman of the Fatherland Front Committee; Chairman of the Elderly Association; Party Committee Office; Vice Chairman of the Party Inspection Committee; Deputy Secretary of the Ho Chi Minh Communist Youth Union; Vice Chairman of the Women's Union; Vice Chairman of the Farmers' Association; Vice Chairman of the Veterans' Association; Chairman of the Red Cross Society; Internal affairs, emulation, rewards, religion, ethnicity; Manager of the Cultural House - Radio Station; Plant protection (or urban, traffic, construction for wards and towns); Veterinary.

- Positions are arranged separately in the ward, including 2 positions: Head of the People's Protection Committee and Deputy Head of the People's Protection Committee.

- Position assigned separately in communes and towns: Permanent police officer.

b) In hamlets, blocks, villages:

- Common positions: Party cell secretary, hamlet, block, and village chief; Village team leader.

- Positions arranged separately in hamlets and villages: Police officer (also deputy hamlet officer), hamlet and village health worker.

- Positions arranged separately in the block: Head of the Civil Protection Team (also deputy head of the block); member of the Civil Protection Team.

Article 3. Allowance level

2. Concurrent allowance level:

A non-professional worker who concurrently holds another non-professional position is entitled to 100% of the allowance for the concurrent position.

Article 4. Support for non-professional workers who quit their jobs due to reorganization

For those who are working part-time and have to stop working due to reorganization according to this Resolution, they will receive a one-time support. The support level is equal to half of the current allowance for each year of working part-time.

Article 5. Implementation costs

The budget for implementing monthly allowances and part-time allowances (including 3% health insurance) for part-time workers in communes, wards, towns, hamlets, blocks and villages shall be implemented according to the contract mechanism based on the number, title and allowance level (including 3% health insurance) prescribed in this Resolution, and shall be balanced in the annual budget expenditure estimates of communes, wards and towns.

Article 6. Implementation

Assign the Provincial People's Committee to implement this Resolution.

Article 7. Implementation provisions

This Resolution was passed by the 16th People's Council of Nghe An province at the 10th session on December 13, 2013 and took effect from January 1, 2014.

Abolish the Resolutions and provisions stipulated in the following Resolutions of the Provincial People's Council:

- Resolution No. 314/2010/NQ-HDND dated July 10, 2010 on regulations on the number, titles and allowance levels for non-professional workers at the commune, hamlet, block and village levels in Nghe An province;

- Resolution No. 295/2009/NQ-HDND dated December 23, 2009 on adding 01 Vice Chairman of the Fatherland Front Committee in communes, wards and towns;

- Article 1 and Article 2 of Resolution No. 45/2012/NQ-HDND dated April 20, 2012 on the number of Deputy Commanders of Commune-level Military Commands and policies for the militia and self-defense forces in Nghe An province;

- Article 1 and Article 2 of Resolution No. 38/2012/NQ-HDND dated April 20, 2012 on the number and some policies for the police force of communes and towns in Nghe An province;

- Article 1 of Resolution No. 229/2008/NQ-HDND dated July 23, 2008 on allowance levels for civil defense forces in the province.
