Drunk driving causes death, driver sentenced
(Baonghean.vn) - In addition to compensating for damages of 70 million VND for violating regulations on road traffic, the Trial Council sentenced Pham Van Le to 36 months in prison.
On the morning of October 31, Tan Ky District People's Court tried a criminal case against Pham Xuan Le (born in 1977), residing in Xuan Yen Hamlet, Tan Xuan Commune, Tan Ky District, for violating regulations on road traffic participation.

According to the indictment, at about 1:30 p.m. on July 20, 2018, Le (with a driver's license) used alcohol with a breath alcohol concentration of 0.536 mg/L while driving a Fanlim motorbike with license plate 37H3 - 3458 from Giai Xuan commune to Tan Hop commune, Tan Ky district.
When arriving at Vinh slope in Xuan Tien hamlet, Giai Xuan commune, he met Mr. Truong Van Xuan (born in 1976), residing in Bau Khe hamlet, Giai Xuan commune, driving a motorbike with license plate 37N1 - 271.81 from Vinh slope down and was turning on the left signal light.
When the two vehicles were 3 to 4 meters apart, Le drove the motorbike to the left, encroaching on the lane where Mr. Xuan was traveling, causing a collision with the motorbike driven by Mr. Xuan, causing Mr. Xuan to die on the way to the emergency room.
In the Forensic Examination Conclusion No. 38/GD-PY dated July 21, 2018 of Tan Ky District Medical Center, it was concluded that the cause of Mr. Truong Van Xuan's death was due to multiple blunt trauma and traumatic brain injury due to a traffic accident.
On August 24, 2018, Le's family and the legal representative of the victim Xuan's family agreed to compensate for damages in the amount of 70,000,000 VND. To date, the legal representative of the victim, Mr. Truong Van Xuan, has not requested any further civil compensation.
At the end of the trial, the jury sentenced Pham Van Le to 36 months in prison, suspended for 5 years.
