Amending and supplementing a number of articles of Decree 99 on forest environmental service payment policy
(Baonghean) - On November 2, 2016, the Government issued Decree 147/2016/ND-CP amending and supplementing Articles 5, 8, 11, 15, 20 and abolishing Clause 7, Point b, Clause 9, Article 22 of Decree 99/2010/ND-CP on the policy of payment for forest environmental services specifically as follows:
1. Clause 1, Article 5 is amended and supplemented as follows:
“1. Organizations and individuals benefiting from forest environmental services must pay for forest environmental services to the forest environmental service provider”.
2. Article 8 is amended and supplemented as follows:
“Article 8. Subjects eligible for payment for forest environmental services
1. The subjects that are paid for forest environmental services are forest owners of forests that provide forest environmental services, including:
a) Forest owners are organizations to whom the State allocates or leases forests for long-term, stable use for forestry purposes, and forest owners are organizations that self-invest in planting forests on allocated forestry land;
b) Forest owners are households and individuals to whom the State allocates or leases forests; village communities are allocated forests to whom the State allocates forests for long-term, stable use for forestry purposes; forest owners are households, individuals, and village communities that self-invest in planting forests on forestry land areas allocated by the State.
2. Organizations, households, individuals, and village communities that have long-term stable forest protection contracts with forest owners who are State organizations (hereinafter referred to as contracted households).
3. The People's Committee at the commune level is assigned by the State the responsibility of forest management according to the provisions of law and provides forest environmental services.
4. Socio-political organizations assigned by the State to manage forests according to the provisions of law provide forest environmental services.

3. Clause 1, Article 11 is amended and supplemented as follows:
“1. For hydropower production facilities
a) The payment rate for forest environmental services applied to hydropower plants is 36 VND/kWh of commercial electricity. The electricity output used to calculate the payment for forest environmental services is the electricity output sold by hydropower plants to electricity buyers under the electricity purchase and sale contract.
b) Determine the amount of money to be paid for forest environmental services
The amount of money to be paid for forest environmental services during the payment period is determined by multiplying the electricity output during the payment period (kWh) by the forest environmental service payment rate per 1kWh (VND 36/kWh)”.
4. Clause 2, Article 11 is amended and supplemented as follows:
“2. For clean water production and supply facilities
a) The payment level for forest environmental services applied to clean water production and supply facilities is 52 VND/m3Commercial water. Water output used to calculate payments for forest environmental services is the water output of clean water production and supply facilities sold to consumers.
b) Determine the amount of money to be paid for forest environmental services.
The amount to be paid for forest environmental services during the payment period is determined by the commercial water output during the payment period (m).3) multiplied by the forest environmental service payment level per 1 m3commercial water (52 VND/m3).
