(Baonghean) -After Nghe An Newspaper published an article reflecting on the case of the Deputy Police Chief of Cong Thanh Commune, Yen Thanh (February 3, 2012) using a tear gas gun to shoot into a house, causing a 5-month-old baby to panic. To handle the issue raised by the newspaper, after checking, on April 10, 2012, Yen Thanh District Police issued Document No. 470/CSDT to report and respond to Nghe An Newspaper about the incident as follows:

At around 10:00 a.m. on January 1, 2012, Mr. Nguyen Xuan Vy - Deputy Police Chief of Cong Thanh Commune asked two cars with license plate 37N-5728 of Mr. Nguyen Van Hung in My Thanh Commune and car with license plate 37C-006.85 of Mr. Thai Danh Gia's family in Thuong Hamlet, Cong Thanh Commune to stop at the raw material road in Dong Muong Hamlet, Cong Thanh Commune, so Mr. Gia and Mr. Vy argued. Nguyen Xuan Vy slapped Mr. Gia in the face, Mr. Gia pushed his hand away hard, hitting Mr. Vy's eye and causing a bruise on his face. Out of anger, Nguyen Xuan Vy went home to get a tear gas gun issued by the Provincial Police to the Cong Thanh Commune Police on July 25, 2007 (expired on July 30, 2010). After getting the gun, Vy went to the scene of the incident and cursed Mr. Thai Danh Gia, yelling at Mr. Linh (Gia's older brother) who came to stop him.

When he knew that Mr. Gia had returned home, Nguyen Xuan Vy continued to go to Mr. Gia's house, threatened to kill Mr. Gia, pushed the iron gate, cursed and called for someone to bring gasoline to burn Mr. Gia's house, but no one brought gasoline. At this time, many people tried to stop him, but Mr. Vy did not listen, but instead walked back and forth many times and continuously cursed Mr. Gia, pushed open the gate lock of Mr. Gia's house and went into the house. Seeing that, Mr. Gia took out a knife and slashed Vy but missed. At that time, Nguyen Xuan Vy pulled out a tear gas gun and fired 1 shot, causing 5-month-old Thai Ba Hieu to be affected by the tear gas. The family took him to the Children's Hospital for examination and treatment and discharged him after 1 day.

The forensic results of the Provincial Police Department's Criminal Science Department concluded: the level of health damage caused by the injury left on Hieu's body at the time of the forensic examination was 0%; the seized evidence included a 50cm long knife with a 5cm wide blade; a tear gas gun with 2 bullets.

Because the level of health impact on Hieu is 0%, Nguyen Xuan Vy's behavior does not constitute a crime of disturbing public order, so the Investigation Agency decided not to prosecute the criminal case. However, Nguyen Xuan Vy's behavior must be administratively handled according to Decree 73/ND-CP dated July 12, 2010 of the Government in the form of a fine and handover to the local authorities for management and education.

Yen Thanh District Police said: After the newspaper reported the incident, the Investigation Police Agency issued a document requesting the Chairman of Cong Thanh Commune People's Committee to suspend Nguyen Xuan Vy from the position of Deputy Commune Police Chief and the Chairman of Cong Thanh Commune People's Committee issued Decision No. 02/QD-UB temporarily suspending Nguyen Xuan Vy from the position of Deputy Commune Police Chief.
