Detain 5 subjects violating land use rights auction
On the evening of December 3, the Investigation Police Agency issued a decision to temporarily detain the following subjects: Pham Ngoc Tuan, Ngo Van Duong, Nguyen Duc Thanh, Nguyen The Trung, Nguyen The Quan, for the act of "Violating regulations on property auction activities".
Previously, in November 2024, Pham Ngoc Tuan (born in 1991, permanent resident of Dong Anh town, Dong Anh district, Hanoi) learned about the auction of land use rights in the project to build technical infrastructure to renovate and develop rural residential areas (Dong Lai village, Quang Tien commune, Soc Son district, organized by the People's Committee of Soc Son district), so he asked Ngo Van Duong (born in 1994, permanent resident of Xuan Non commune, Dong Anh district, Hanoi) to buy the auction documents issued by Thanh Xuan Company (address: Nhan Chinh ward, Thanh Xuan district, Hanoi) - the unit coordinating the auction organization.

To ensure winning the auction of the desired plots of land, Pham Ngoc Tuan agreed and discussed with Nguyen Thi Quynh Lien (born in 1981, permanent residence in Nguyen Khe commune, Dong Anh district), Nguyen Duc Thanh (born in 1992, permanent residence in Lam Lang area, Van Duong ward, Bac Ninh city, Bac Ninh province), Nguyen The Trung, Nguyen The Quan and Ngo Van Duong (all born in 1994, permanent residence in Xuan Non commune, Dong Anh district) about participating in the auction and discussed and agreed to raise the price at the auction.
Specifically, Tuan has provided a reference price list for each plot of land that Tuan has calculated and prepared in advance. According to this table, the plots of land have values ranging from 20 million VND to 32 million VND/m2, estimated from 1.7 billion VND - 3.9 billion VND/plot of land. The subjects determined that this was the highest price that could be purchased for each plot of land, so if in the 4th round, the highest bidder was still below the price Tuan had recorded in the spreadsheet, the group of Duong, Lien, Thanh, Quan and Trung would continue to participate in the 5th and 6th rounds but would not bid more than the price assessed by Tuan. If in the 4th round someone bids more than the maximum price given by Tuan, the subjects would offer an unusually high price in the 5th round, but would drop out of the auction in the final round (6th round); therefore, the auction would be forced to stop and be re-auctioned next time, due to not having enough 6 rounds of bidding according to the regulations. At that time, the subjects would not lose their deposit and would have the opportunity to continue participating in the auction to buy the plot of land as desired.
To carry out their plan, the subjects transferred money to Duong and Tuan; then Tuan transferred a total of 3.616 billion VND to Thanh Xuan Company as a deposit.land auction
In fact, at the auction on November 29, the auction subjects initially bid in order of the price they could afford. However, when they discovered that the auction price of 36/58 plots exceeded the maximum price that the subjects had discussed in advance; in the 5th round of auction, the subjects offered very high prices, far exceeding the starting price; Pham Ngoc Tuan even offered a price of over 30 billion VND/m2 (about 12,000 times higher than the starting price)... leading to the 36 plots of land being unsuccessfully auctioned.
Faced with unusual signs of the auction, the Director of Hanoi City Police has directed the Department of Investigation of Corruption, Economic, Smuggling and Environmental Crimes to coordinate with relevant units to urgently investigate, verify and clarify the acts with signs of law violations by the subjects. At the same time, direct professional units to strengthen inspection, promptly detect, combat, prevent and strictly handle acts of taking advantage of legal policies to commit illegal activities in the field of property auctions in general and land use rights auctions in particular in the city.
The City Police Investigation Agency is consolidating documents and evidence to initiate a case, prosecute the accused, and strictly handle related subjects according to regulations.
