Temporary residence for 2 years before permanent registration

On June 20, 2013, the National Assembly passed the Law amending and supplementing a number of articles of the Law on Residence, No. 36/2013/QH13, of which the most notable is the regulation on permanent residence registration in centrally run cities.

Previously, the Law on Residence No. 81/2008/QH11 stipulated that one of the cases eligible for permanent residence registration in a centrally run city was: Citizens with legal residence and have continuously resided in that city for one year or more; then this amended and supplemented Law has adjusted as follows: Citizens with legal residence, if registering for permanent residence in a district or town under a centrally run city, must have a temporary residence period in that city of 01 year or more; if registering for permanent residence in a district under a centrally run city, must have a temporary residence period in the city of 02 years or more.

In addition, in the case of citizens registering for permanent residence in a legal accommodation due to renting, borrowing, or staying at a house of an individual or organization, in addition to meeting the conditions of having the written consent of the lessor, lender, or host, they must also ensure the average area of ​​that accommodation according to the regulations of the City People's Council and have confirmation from the People's Committee of the commune, ward, or town on the average area condition.

Another notable adjustment of this Law is the regulation that the representative of the family, collective housing, medical facility, hotel, motel, or other facility, when a person comes to stay, must be responsible for notifying the stay to the Commune, Ward, or Town Police (instead of the regulation that the person coming to reside is 14 years of age or older, the representative of the family, collective housing, medical facility, hotel, or motel must notify). At the same time, this Law also adds a regulation that in case the head of the family or collective housing does not register permanent residence in that commune, ward, or town, the person coming to stay is responsible for notifying the stay to the Commune, Ward, or Town Police.

This Law comes into force from January 1, 2014.
