Strengthening the fight against smuggling of gasoline, oil and minerals in the area
(Baonghean.vn) - On December 25, 2014, the People's Committee of Nghe An province issued Plan 709/KH-UBND to implement Directive No. 25-CT/TU dated November 18, 2014 of the Standing Committee of Nghe An Provincial Party Committee on strengthening the fight against smuggling of gasoline, oil, and minerals in the province. The contents are as follows:
Pursuant to Directive No. 25-CT/TU dated November 18, 2014 of the Standing Committee of Nghe An Provincial Party Committee on strengthening leadership and direction against smuggling of gasoline, oil and minerals in the province, Nghe An Provincial People's Committee issued the following Implementation Plan:
I. Purpose and requirements:
1. Thoroughly grasp and seriously implement Directive No. 25-CT/TU dated November 18, 2014 of the Provincial Party Standing Committee on strengthening leadership and direction against smuggling of gasoline, oil and minerals in the province, thereby raising awareness and sense of responsibility for cadres and people; promoting the combined strength of the entire political system and all classes of people in preventing and combating smuggling and trade fraud, especially for gasoline, oil and minerals in the province.

2. Focus on directing and synchronously implementing proactive measures to prevent, combat, arrest, and strictly handle acts of smuggling and trade fraud, especially in the transportation and smuggling of gasoline, oil, and minerals.
3. Improve the effectiveness of coordination between agencies, units and forces in inspecting, controlling, preventing and handling activities of transporting and smuggling of gasoline, oil and minerals.
II. Content
1. Continue to advise Party committees and authorities at all levels to strictly implement Directive No. 25-CT/TU dated November 18, 2014 of the Provincial Party Standing Committee on strengthening leadership and direction against smuggling of gasoline, oil, and minerals in the province; improve the effectiveness of state management in the fields of transportation, gasoline trading, mineral exploitation and trading, contributing to market stability, increasing budget revenue, promoting investment, and developing production and business.
2. Directing to promote propaganda, education and mobilization work in various forms to raise awareness and consciousness among traders and people of all walks of life in the province about Directive No. 25-CT/TU dated November 18, 2014 of the Provincial Party Standing Committee.
3. Strengthen inspection, control, detection and timely handling of violations of smuggling and trade fraud in accordance with the law, especially in the fields of gasoline, oil and mineral trading.
4. Review legal documents related to state management in the field of anti-smuggling, anti-counterfeiting, and trade fraud, and propose solutions to strengthen state management of activities of transportation, trading of gasoline, oil, and exploitation and trading of minerals.
5. Periodically, do a good job of reporting on the implementation results of the Provincial Party Committee's Directive to the Provincial People's Committee for monitoring, evaluation, and direction; organize preliminary and final summaries, and draw lessons. Do a good job of emulation and commendation for units and localities that implement it promptly and effectively, and criticize units and localities that implement it ineffectively and irresponsibly.
III. Task assignment
1. Department of Industry and Trade
- Preside and coordinate with relevant departments, branches and sectors to organize propaganda and dissemination of Directive No. 25-CT/TU dated November 18, 2014 of the Provincial Party Committee Standing Committee and related regulations on prevention and combat of smuggling and trade fraud to officials and civil servants of departments, branches and sectors and districts, cities and towns. Review legal documents with contents related to state management in the field of anti-smuggling, anti-counterfeiting, trade fraud, propose solutions to strengthen state management of transportation activities, petroleum trading, mineral exploitation and trading.
- Direct the Market Management Department to coordinate with relevant functional forces and People's Committees of districts, cities and towns to strengthen the inspection and control of compliance with regulations by traders transporting and trading in gasoline, oil and minerals; implement measures to prevent and combat smuggling, trade fraud and strictly handle violations. Timely report to the mass media on the inspection and control activities of the Market Management force, the inspection and handling of smuggling, counterfeit goods and trade fraud in the business of gasoline, oil and minerals in the province.
2. Provincial Police
- Directing functional forces to detect, investigate, verify and clarify smuggling lines of gasoline, oil and minerals for handling according to the provisions of law; at the same time, coordinate with media agencies to promptly propagate and report on violators of smuggling and commercial fraud in the business of gasoline, oil and minerals according to regulations.
- Coordinate with functional forces to promptly detect and handle subjects and means of transporting and smuggling gasoline, oil, and minerals on roads, waterways, sea routes, and key areas; strengthen inspection and strictly handle illegal mineral exploitation activities that cause environmental pollution, contributing to preventing illegal mineral smuggling and transportation out of the area.
3. Provincial Border Guard Command
- Strengthen patrolling, control, monitoring, and detection of acts of transporting and smuggling goods from abroad and illegally exporting ores and minerals abroad to arrest and handle. Review and list organizations, networks, and subjects; specifically identify professional subjects and means of transporting smuggled goods and smuggled goods in the area.
- Closely coordinate with the Police, Customs, Market Management and other functional forces to organize situation monitoring, inspection, control, ambush, arrest and handle subjects with activities related to mineral and gasoline smuggling.
4. Customs Department
Actively coordinate with functional forces and local authorities to identify key subjects smuggling gasoline, oil, and minerals, to have plans and strategies to effectively combat gasoline, oil, and mineral smuggling. Have a plan to grasp the situation in areas where smugglers can use
5. Department of Natural Resources and Environment
- Periodically assess the environmental status at petrol stations.
- Inspect, examine and supervise mineral activities of organizations and individuals; resolve disputes, complaints and denunciations about mineral activities and handle or recommend handling of violations of mineral laws according to the provisions of law;
6. Department of Science and Technology
- Direct the Department of Standards, Metrology and Quality to preside over and coordinate with the Police and Market Management agencies to effectively manage the fields of standards, metrology, product and goods quality, and the work of appraisal and testing of goods to serve the fight against smuggling of gasoline, oil and minerals in the area.
- Preside over and coordinate with competent authorities to carry out inspection, examination, professional guidance and handling of violations in the field of product quality measurement standards and industrial property.
7. Department of Finance
Provide financial support to ensure working conditions for propaganda and communication work; patrol, inspection and control vehicles for functional agencies to combat smuggling of gasoline, oil and minerals in the province.
8. Nghe An Newspaper, Provincial Radio and Television Station
- Timely information and propaganda on propaganda, fight against smuggling and trade fraud in gasoline and oil trading; mineral exploitation and trading in the province.
- Build a propaganda page, disseminate legal documents related to the fight against smuggling, trade fraud and counterfeit goods such as: Law on Handling of Administrative Violations, Law on Commerce, Law on Intellectual Property; Government Decrees on petroleum business; mineral exploitation and business.
- Prioritize the timing and duration of news coverage to promote the work of anti-smuggling, trade fraud and counterfeit goods by the authorities. Highlight typical examples of good people and good deeds, and promptly report on violations detected and handled by the authorities.
9. People's Committee of district, city, town
- Develop plans and organize the implementation of propaganda on the Party's guidelines and policies and the State's laws; mobilize production and business organizations, individuals and people to actively participate in the fight against smuggling, counterfeit goods, trade fraud and other illegal business activities. In the process of implementation, coordinate with mass media agencies to report on the activities of local authorities.
- Coordinate with departments, branches, sectors and functional forces to strengthen inspection and supervision of smuggled goods and goods of unknown origin, especially in the business activities of gasoline, oil and minerals in the area.
IV. Implementation
1. Provincial departments, branches, sectors and People's Committees of districts, cities and towns develop detailed plans and implement them seriously and effectively. Periodically every quarter, six months, annually or suddenly when requested, report the implementation results to the Provincial People's Committee (through the Department of Industry and Trade) for monitoring, synthesizing and reporting to the Provincial Party Committee and the Provincial People's Committee in accordance with regulations.
2. The Department of Industry and Trade shall regularly monitor, guide, inspect and urge units and localities to implement this plan. Synthesize and report to the Provincial Party Committee and Provincial People's Committee on the implementation results in accordance with regulations./.
