Aircraft leased for more than 24 months must be registered as Vietnamese nationality.

The Government has just issued a Decree regulating nationality registration and registration of rights to aircraft.

The above Decree takes effect from October 1, 2015, regulating the registration of nationality and registration of rights to aircraft in Vietnam, including: Registration and deregistration of nationality of aircraft; registration and deregistration of rights to aircraft; granting codes to register and deregistration of international rights to aircraft with Vietnamese nationality; registration and deregistration of documents designating persons with the right to request deregistration or export of aircraft.

The Decree does not regulate the registration of nationality and registration of rights for official aircraft, including military aircraft, specialized aircraft of customs and police forces and other aircraft used for state official purposes, except in cases where official aircraft are used for civil purposes.

According to the provisions of the Decree, aircraft owned by Vietnamese organizations or individuals, leased-purchased or leased aircraft without crew for a lease term of 24 months or more for operation in Vietnam must be registered with Vietnamese nationality according to the provisions of this Decree.

Within 6 months from the date of import into Vietnam, the aircraft must be registered with Vietnamese nationality.

Aircraft registered with Vietnamese nationality must meet the following conditions: Not having the nationality of any country or having deregistered foreign nationality; Having legal documents proving ownership of the aircraft; right to possess the aircraft in case of lease-purchase or aircraft leasing; For used aircraft, it must meet the requirements on the age of the aircraft as prescribed by law; Meeting the conditions and requirements on ensuring national defense, security; aviation safety, aviation security and environmental protection as prescribed by law.

The Decree also clearly states that an aircraft is deregistered as having Vietnamese nationality when the aircraft is declared missing in accordance with the provisions of law; the aircraft no longer meets the prescribed conditions; at the request of the aircraft owner or the person requesting aircraft registration; at the request of the person designated in the IDERA document./.
