"Corruption from 1 billion VND or more must be punished by death"

Establishing independent agencies, increasing penalties, requiring retirees to declare their assets... Impatient with the rampant corruption, voters across the country have sent many specific proposals to the National Assembly.
According to the results of resolving voters' petitions sent to the 5th session of the National Assembly, the people sent to the National Assembly's Judicial Committee many concerns about the effectiveness of anti-corruption work.
Voters in the provinces of Binh Dinh, Soc Trang, Binh Thuan, Ninh Thuan, and Binh Phuoc said that in recent times, the fight against corruption has been actively directed by the Party, State, and Government, but has not yet achieved the results that the majority of voters desire.
Responding to this opinion, the Judiciary Committee assessed that in recent years, the National Assembly and its agencies have strengthened and made many efforts in the work of supervising and preventing corruption, however, the results achieved are only initial and have not fully responded to the people's aspirations.
Accepting voters' recommendations, the Judicial Committee "promised" that in the coming time, it would strengthen supervision of corruption prevention and detection and handling of corrupt acts, contributing to improving the responsibility and effectiveness of competent agencies in this work; ensuring strict handling of those who commit corrupt acts. At the same time, it would supervise the public disclosure of the results of handling major corruption cases in accordance with the law.
Regarding the solution, voters of An Giang province suggested that the National Assembly should have a separate independent agency, not directly under the locality, to perform its duties well. Otherwise, even if the President or the General Secretary is assigned to be the Head of the Committee, it would be the same, because the members of the Committee are all people who hold concurrent positions in ministries and branches (the same is true in localities). Thus, the situation of both playing football and blowing the whistle still occurs, "just changing the color of the shirt".
According to the response of the Judiciary Committee, the establishment of an independent agency in the prevention and fight against corruption is an important innovation related to the provisions of the Constitution and laws on the organization of the state apparatus. This issue needs to be summarized, assessed in practice comprehensively, and studied in synchronization with the amendment of the Constitution and laws on the organization of the state apparatus.
In response to voters' opinions, the Judiciary Committee will recommend that the National Assembly and the National Assembly Standing Committee assign the Government and relevant agencies to study and propose specific plans for fundamental and comprehensive amendments to the Law on Anti-Corruption in the coming time.
Still related to the solution, voters of Tien Giang province proposed that the National Assembly consider and amend the Penal Code in the direction of handling corruption based on the value of corruption. Specifically: those who corrupt from 1 billion VND or more must be sentenced to death, and assets obtained from corruption must be recovered; for those who corrupt under 1 billion VND, depending on the level, appropriate prison sentences will be applied. At the same time, those who are corrupt will not be entitled to pension policies according to the law on social insurance and other policies of the Party and State.
In the coming time, in the process of examining, revising and perfecting the Penal Code (amended), the Judicial Committee will pay attention to these contents, ensuring strict criminal policies against corruption crimes, meeting the requirements of the fight against corruption in the current situation, the Judicial Committee accepts.
Voters in Ca Mau province reported that some officials and civil servants, after retiring or changing careers, have built billion-dollar houses. The proposal sent to the National Assembly is to add to the Anti-Corruption Law that retired officials and civil servants must also declare their assets to clarify where the money and assets come from.
According to the Judicial Committee, the Law amending and supplementing a number of articles of the Law on Anti-Corruption has just been passed by the National Assembly and is in the process of being deployed and implemented. According to the provisions of the Law, it does not exclude the handling of retired people who, during their term of office, violated corruption laws.
In response to voters' opinions, the Judiciary Committee recommended that the National Assembly assign the Government to coordinate with relevant agencies to continue researching, summarizing, and evaluating to comprehensively amend the Law on Anti-Corruption in the coming time, especially on issues such as controlling assets, income of officials, civil servants, public employees, and people with positions and powers, even in cases where they have retired; regulations on protecting corruption whistleblowers, etc.
With the same concern about asset declaration, voters in Vinh Phuc province said that the current Anti-Corruption Law requires dishonest declaration of assets by those responsible for declaration, falsifying management records but has not been handled.
Voters in Lam Dong province also proposed that the Law on Anti-Corruption must clearly stipulate the disclosure of assets of Party and State leaders to the people.
The Judicial Committee stated that Article 44 and Article 46a of the Anti-Corruption Law specifically stipulate the responsibility for declaring assets, the time limit, and the procedures for declaring assets of officials and civil servants, including leaders of the Party and the State. To institutionalize this regulation, on July 17, 2013, the Government issued Decree 78/2013/ND-CP on transparency of assets and income, which specifically stipulates the subjects, procedures, and scope of public disclosure of asset and income declarations.
Responding to voters, the Judiciary Committee expressed its determination to continue to monitor and request competent authorities to actively, proactively, and strictly and legally handle acts of corruption, minimizing the exemption of criminal liability, suspension of cases, suspension of defendants, and application of penalties that are not in accordance with the law.
In addition, the Committee will strengthen supervision of the detection and handling of people with corrupt behavior, review disciplinary cases against those with behavior related to corruption, avoid missing criminals; ensure strict handling, correct people, correct crimes, and in accordance with the law.
