Group discussion on Labor Code and Trade Union Law
(Baonghean) -This afternoon, November 16, the National Assembly discussed in groups the Labor Code (amended) and the Trade Union Law (amended). The National Assembly delegation of Nghe An province discussed in group number 5 with the delegations of Vinh Phuc and Dak Lak provinces.
Comrade Phan Dinh Trac - Member of the Party Central Committee, Secretary of the Provincial Party Committee - Head of the National Assembly Delegation of Nghe An province chaired the discussion.
The current Labor Code consists of 7 chapters and 223 articles., dThe draft Labor Code (amended) retains the same number of chapters.is 7 chapters and increases the number of articlestotal 273 articles (tthereMaintain 52 articles, amend 157 articles and add 64 new articles).
Speaking at the discussion, most of the delegates from Nghe An, Vinh Phuc and Dak Lak highly agreed with the need to issue a revised Labor Code. However, the delegates suggested that the Code should clearly define the responsibilities of agencies, ministries, and provincial People's Committees regarding state management. Regarding overtime, the delegates suggested thatKeep as current regulations, maximum 200 hours in a year except for some special cases where overtime is not more than 300 hours in a year.Delegates proposed to increase 1 day off for Lunar New Year from 4 days to 5 days.
Aboutgender equality and retirement age for workers,some delegatesIt is recommended to keep it as the current regulations, which is 60 years old for men and 55 years old for women under normal working conditions.. DwithFor special workers such as those working in arduous, toxic environments, etc., or workers with high technical expertise, or workers in management positions, the retirement age will be determined by the Government. At the same time, the Government will be assigned to regulate the retirement age for certain types of special workers when the workers voluntarily extend their working time and have the consent of the employer.(Article 199). In addition, some opinions suggest raising the working age.63age for male and 58age for female.
Regarding salary regulations, delegates agreed with the draft, but businesses must ensure workers' lives with a minimum wage.Around the problemOn collective labor agreements in the industry, some delegatesIt is recommended that there should be regulations to encourage labor collectives and employers to build collective labor agreements in enterprises.,But in the long term, there should still be regulations on industry collective labor agreements to create a legal framework for negotiating and signing industry agreements in the future..Delegates also agreed to a maternity leave period of 6 months for women.
Discussing the Trade Union Law, delegates highly agreed with the draft revised Law. However, the delegates proposed that the legal status of the Trade Union and the functions of the Trade Union should be combined into Article 1. Regarding the right to join and operate trade unions of foreign workers, the delegates said that it should be stipulated that "foreign workers working at foreign-invested enterprises in Vietnam or working at foreign-invested enterprises in Vietnam, with a labor contract term of 1 year or more, having a work permit from a competent authority, voluntarily and acknowledging the Charter of the Vietnam Trade Union, during their working time in Vietnam have the right to join the Vietnam Trade Union, and when they no longer work in Vietnam, they will no longer join the Vietnam Trade Union. Regarding the minimum number of workers to establish a grassroots trade union organization, the delegates proposed that it must be from 20 workers or more. Regarding the issue of the names of trade unions at all levels, some delegates suggested that it should be kept as it is now, but some delegates said that the general name of the Vietnam Trade Union should be unified.
Tomorrow, November 17, in the morning, the National Assembly will discuss in the hall the draft law and ordinance making program of the 13th National Assembly term, and in the afternoon, the draft Law on Dissemination and Education of Law will be discussed.
