Unanimous proposal on penalties for unregistered vehicles
The Ministry of Transport has just sent a dispatch to the Government reporting on a draft Decree regulating administrative sanctions; in which, this ministry, together with the Ministry of Public Security and the Ministry of Justice, have agreed to propose adding a regulation on penalties for vehicles that have not been transferred to another owner.

In Official Dispatch No. 9176/BC-BGTVT, the Ministry of Transport said that at the end of August, Minister of Transport Dinh La Thang chaired a meeting with the Ministry of Public Security and the Ministry of Justice to unify views on administrative sanctions for violations of not transferring vehicle ownership according to regulations and to collect opinions on the impact of the document on the requirements for protecting security and order.
Accordingly, representatives of the above ministries agreed to propose adding to the Draft Decree the content regulating penalties for not transferring vehicle ownership to ensure the effectiveness and efficiency of State management and the legal rights and obligations of vehicle owners.
Specifically, the ministries also proposed that the penalty for owners of motorbikes and similar vehicles that commit the violation of not transferring vehicle ownership be implemented from January 1, 2017.
Fines for owners of cars, tractors, special-purpose vehicles and vehicles similar to cars when committing the above violations will be implemented from January 1, 2015.
In addition, the ministries also agreed to add to the Draft Decree the content of regulations limiting the cases of inspection and punishment for the above violations, in order to minimize the possibility of abuse and causing inconvenience to people when participating in traffic.
According to the proposal of these agencies, the verification of vehicle ownership can only be done through investigation, settlement of serious traffic accidents and through vehicle registration for punishment. The fine for this act remains the same as Decree 34/2010 and must be applied in a roadmap, not causing difficulties for people.
On the other hand, to add the regulation on penalties for vehicles that do not change ownership to the Draft Decree, the Ministries also stated that it is necessary to clearly stipulate some contents such as clearly defining the subjects responsible for carrying out the procedures for registering the transfer of ownership, moving the vehicle when the vehicle is bought, sold, donated, inherited and simplifying the procedures for paying vehicle registration fees to make it more convenient for people when carrying out the procedures for changing ownership. Especially in cases where the vehicle has been transferred to many people without sufficient transfer documents, it is necessary to describe it again to clearly identify the violation and the violator.
To implement these contents, the Ministry of Transport proposes that the Government direct the Ministry of Public Security to urgently amend Circular No. 36/2010/TT-BCA dated October 12, 2010 and Circular No. 12/2013/TT-BCA dated March 1, 2013 (before the Decree takes effect); the Ministry of Finance urgently studies, amends and supplements regulations on paying vehicle registration fees to create more convenience for people when carrying out procedures for vehicle registration and transfer./.
According to Decree 34/2010/ND-CP, individuals who own motorbikes and similar vehicles will be fined from 100,000 to 200,000 VND if they do not transfer ownership of the vehicle; and individuals who own cars, tractors, and specialized vehicles will be fined from 1 to 2 million VND if they do not register the vehicle name change as prescribed.
