Agree to submit to Nghe An Provincial People's Council a draft policy to support redundant cadres and civil servants due to merger
On the afternoon of October 10, the Legal Committee of the Provincial People's Council held a meeting to review the draft resolution submitted to the 23rd session (special session) of the 18th Provincial People's Council, term 2021 - 2026 on policies for cadres, civil servants, public employees, labor contracts, part-time workers and other subjects redundant due to the arrangement of administrative units at district and commune levels in Nghe An province.
Attending the meeting were comrade Nguyen Nam Dinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Council; leaders of the Provincial People's Committee Office and a number of relevant departments and branches.
Comrade Pham Thanh Chung - Standing Member, Head of the Legal Committee of the Provincial People's Council chaired the inspection.

The draft resolution regulating support policies for cadres, civil servants, public employees, labor contract workers, part-time workers and other redundant subjects due to the rearrangement of district and commune-level administrative units in Nghe An province is built in the spirit of Resolution No. 35, dated July 12, 2023 of the National Assembly Standing Committee and the province's budget balancing capacity.

According to the draft, cadres, civil servants, public employees, and people working under labor contracts, in addition to the regime and policies on streamlining payrolls as prescribed by current law, will be supported with an additional 3 months of current salary for each year of early retirement compared to the prescribed retirement age in cases of early retirement; supported with 1 month of current salary for each year of work with compulsory social insurance contributions in cases of immediate resignation; supported with 1 month of current salary for each year of work at the current working position for those receiving pensions who hold the position of district- or commune-level officials.

For non-professional workers, in addition to the regime and policies enjoyed according to current law, when retiring, they will be supported for each year of work in the current position (excluding concurrent positions) equal to 1 month of current allowance (maximum support not exceeding 15 months).
Similarly, Standing members of the Vietnam Fatherland Front and members of the Standing Committees of commune-level socio-political organizations are supported one time with an amount of VND 3,200,000/person.

Regarding the implementation period of the regime, according to the draft resolution, for cadres, civil servants, public employees, and labor contracts at the district and commune levels, the regime will be implemented within 5 years from the effective date of the resolution of the National Assembly Standing Committee on the arrangement for each administrative unit. For part-time workers at the commune level, the regime will be implemented within 1 year from the date of the arrangement decision by the competent authority.
This policy does not apply to those who retire due to reaching retirement age as prescribed during the administrative unit arrangement period; cadres who do not meet the age requirements for re-election, reappointment, or retirement according to Decree No. 26, dated March 9, 2015 of the Government.

At the review meeting, based on the opinions of the meeting participants; Director of the Department of Home Affairs Nguyen Viet Hung received and clarified a number of issues related to the legal and practical bases for policy development; resources to ensure policy implementation; subjects to which the policy applies; and implementation provisions.
Concluding the review meeting, Comrade Pham Thanh Chung - Standing Member, Head of the Legal Committee of the Provincial People's Council agreed to submit to the Provincial People's Council for consideration and approval of a resolution on support policies for cadres, civil servants, public employees, labor contracts, part-time workers and other redundant subjects due to the rearrangement of administrative units at district and commune levels in Nghe An province. At the same time, he requested the Department of Home Affairs to fully absorb the opinions of the meeting participants to complete the draft resolution before submitting it to the Provincial People's Council.
