Unifying Party's will and people's heart
(Baonghean) -The draft Constitution of the Socialist Republic of Vietnam (amended) was passed by the National Assembly (13th tenure) with an almost absolute majority of votes, 486/488 delegates (97.59%). This is the result of the responsible work of the National Assembly delegates, of our compatriots and soldiers at home, and of our overseas Vietnamese.
The new Constitution continues to affirm the role and position of the Communist Party of Vietnam, affirming the leadership position of the Communist Party in the State and society, clearly defining the Party's responsibilities. Article 4 of the 1992 Constitution did not clearly state the Party's responsibilities, but this time the revised Constitution has included them and emphasized that the Party must be closely attached to the people, must be subject to the people's supervision and must be responsible to the people for its decisions. If the decision is incorrect, affecting the interests of the nation, the people, the Party must be responsible to the people and the nation.
The new Constitution is the crystallization of the Party's will and the people's heart, reflecting the people's will and aspirations and institutionalizing the Party's guidelines, policies and strategies, and Vietnam's reality, meeting the requirements of protecting and developing the country in the new period; affirming that State power is unified with division, coordination and control among legislative, executive and judicial agencies to ensure that people's power is strictly exercised.
The new Constitution does not include the content of the Constitutional Council, but in the chapters, other articles also show the spirit and principle that legislative power belongs to the National Assembly, executive power belongs to the Government, judicial power belongs to the court and in those chapters, the functions and tasks of each agency are more clearly defined, that division of tasks also creates conditions for the Constitution to control power. Everything that the Constitution has stipulated must be guaranteed to be implemented and respected, no one can violate, anyone who violates must be punished. The new Constitution also affirms that all economic sectors are protected by the State and the State does not nationalize the legal assets of investors, manufacturers, and traders; affirms that the legal ownership of economic sectors, entities including individuals are respected by the State, ensuring that this is their sacred right.
The new Constitution has acknowledged, recognized and respected the United Nations Charter as well as international treaties to which Vietnam is a member. Most clearly, the provisions on human rights have been solemnly recorded in a separate chapter along with the basic rights and obligations of citizens, demonstrating Vietnam's special concern in ensuring and promoting human rights. Children's rights are also more clearly expressed in accordance with the International Convention on the Rights of the Child, which Vietnam was the second country in the world and the first country in Asia to ratify after the Convention was adopted by the United Nations General Assembly.
It is very touching to see the approval of the draft amendment to the 1992 Constitution, the new Constitution truly embodies the crystallization of the wisdom of the entire people, the solidarity and unity between the Party's will and the people's heart. We have the right to expect that after the adoption of the Constitution (amended) as well as the Land Law (amended), the economic, political and social situation of the country will have many positive changes, the people will enjoy many benefits, be more prosperous, happy and more excited, more successful. Vietnam will increasingly enhance its international position, truly becoming an active and responsible member of the common house of the world.
The new (amended) Constitution will only be effective when the amended contents are actually put into practice, State agencies must perform their functions, tasks and powers as stipulated in the amended Constitution, laws, ordinances and legal documents issued before the effective date of the amended Constitution must be reviewed for amendment, supplementation or new issuance in accordance with the amended Constitution. At the same time, it is necessary to do a good job of propaganda so that all Vietnamese citizens strictly comply with the Constitution and the Law, and contribute many constructive opinions so that State power agencies at the central and local levels become increasingly stronger.
