Passing a Resolution guiding the vote of confidence for people holding positions elected or approved by the National Assembly or People's Council

On the last working day of the 14th Session, on the morning of January 16, after providing many comments and suggestions for the Drafting Committee to consider and revise, the National Assembly Standing Committee passed a Resolution guiding the implementation of Resolution No. 35/2012/QH13 of the National Assembly on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly and People's Councils.

This is the draft Resolution that the National Assembly Standing Committee first commented on at the 13th session (December 2012). After the session, based on the direction of the National Assembly Standing Committee, the Law Committee continued to complete the draft Resolution.

Regarding the scope, this Resolution guides the implementation of a number of articles of Resolution No. 35/2012/QH13 of the National Assembly with guiding contents including a group of regulations on: People who are subject to a vote of confidence, a vote of no confidence; the time of organizing the annual vote of no confidence; the content of the report and the responsibility to explain of the person subject to a vote of no confidence; the verification and response to issues requested by National Assembly deputies and People's Council deputies; the form of ballot used in the vote of no confidence, a vote of no confidence; counting and announcing the results of the vote of no confidence, a vote of no confidence; handling the results of the vote of no confidence, a vote of no confidence; resignation, dismissal, removal, approval of dismissal, removal and proposal, recommendation to the National Assembly, People's Council to vote of no confidence for people holding positions elected or approved by the National Assembly, People's Council.

Basically, the members of the National Assembly Standing Committee agreed with the contents of the draft. The National Assembly Standing Committee suggested that the drafting agency should further clarify the accountability of the person being voted on, the vote of confidence, in the direction of specifying the criteria, content of explanation, and reports related to the political qualities, ethics and lifestyle of the person being voted on.

Members of the National Assembly Standing Committee said that the vote of confidence must be conducted very carefully and closely because it is closely related to the political life of officials.

Chairman of the Economic Committee Nguyen Van Giau suggested: The guiding resolution should specify the time limit for verifying issues related to the person being selected and voted for; clarify the method of determining the highest position of those subject to the vote of confidence.

The resolution needs to be built in a way that creates peace of mind and stability for those who are voted for, avoiding unnecessary stress, said Chairwoman of the Committee for Social Affairs Truong Thi Mai.

Commenting on the ballot form in the process of taking a vote of confidence, Vice Chairman of the National Assembly Uong Chu Luu proposed to choose the ballot form for the National Assembly and People's Councils at all levels as in option two of the draft Resolution. According to this option, the ballot of confidence used in the process of taking a vote of confidence includes separate ballots for each position or group of positions corresponding to the order of election or approval by the National Assembly or People's Council at the first session as prescribed in the National Assembly Session Rules and the People's Council Operating Regulations. Each ballot clearly states the full name and position elected or approved by the National Assembly or People's Council of the person or persons subject to the vote of confidence, along with boxes corresponding to the levels of "high confidence", "confidence", "low confidence."

Vice Chairman of the National Assembly Uong Chu Luu also suggested that the drafting agency add to the Resolution guidelines on how to discuss in Groups and Delegations; coordination with organizations and officials in case of resignation or replacement of officials due to low confidence results.

Commenting at the working session, National Assembly Chairman Nguyen Sinh Hung requested members of the National Assembly Standing Committee to study, review, and provide full guidance on the contents of Resolution 35 in a detailed manner similar to the election regulations. In particular, the National Assembly Chairman noted that the Drafting Committee should pay attention to detailed regulations on the resignation guidance process; replacing officials in cases of low confidence. The National Assembly Chairman also requested the Law Committee to study and develop a Resolution with the selection of ballot samples, regulations on the validity of ballots in a reasonable and strict manner, to avoid risks during the voting process and taking votes of confidence.

Also in this morning's working session, the National Assembly Standing Committee gave opinions on the establishment of the State Audit Inspectorate under the State Audit, renaming the Department of International Relations to the Department of International Cooperation, and allocating investment capital for the 2013-2015 period for projects of State Audit's office buildings./.
