Procedures for registering a vehicle that has been sold to many owners
The Ministry of Public Security has just issued a Circular12/2013/TT-BCAAmending and supplementing Clause 3, Article 20 of Circular 36/2010/TT-BCA regulating vehicle registration. Including regulations on handling vehicle registration in cases where the vehicle has been registered and transferred to many people.

Specifically, from April 15, 2013 to December 31, 2014, the handling of vehicle registration in cases where vehicles have been registered and transferred to many people is carried out as follows: For vehicle name change within the same province, in case the person using the vehicle does not have vehicle transfer documents, the vehicle name change registration file includes: Vehicle name change registration declaration (according to the form) with a commitment from the person using the vehicle to be legally responsible for the vehicle registration procedure, with confirmation of the permanent address of the person using the vehicle from the police of the commune, ward, or town (commune-level police) where the person using the vehicle is a permanent resident; Documents for payment of vehicle registration fees according to regulations; Vehicle registration certificate, license plate (in case of loss of vehicle registration certificate or license plate, the reason must be clearly stated in the vehicle registration declaration).
In case the person using the vehicle has the transfer documents of the person named in the vehicle registration certificate and the transfer documents of the last seller, in addition to the above documents, he/she must also present the transfer documents of the person named in the vehicle registration certificate and the transfer documents of the last seller.
In the case of vehicle registration and transfer from one province to another, the vehicle registration and transfer documents do not require submission of the transfer documents of the person whose name is on the vehicle registration certificate and the transfer documents of the last seller if the person using the vehicle does not have this type of document.
Time limit for handling vehicle name change The Circular clearly states that in the case of vehicle name change procedures within the same province, in the case where the vehicle user has transfer documents of the person named in the vehicle registration certificate and transfer documents of the last seller, the vehicle registration agency receives the vehicle name change registration application, checks all required procedures, and writes an appointment letter for the vehicle user. Within 2 working days from the date of receiving all valid documents, the vehicle registration agency must process the issuance of license plates and vehicle registration certificates to the vehicle user.
In case the vehicle user does not have the vehicle transfer documents, the registration agency shall receive the vehicle registration transfer application, check that all required procedures are met, collect the vehicle registration certificate and license plate; and write an appointment letter for the vehicle user. The appointment letter shall be signed and stamped by the head of the vehicle registration agency and shall be valid for vehicle use within 30 days of waiting for the vehicle registration agency to return the results.
The vehicle registration authority sends a notice to the person whose name is on the vehicle registration and publicly posts it at the vehicle registration authority's headquarters, searches the stolen vehicle archive and vehicle registration data.
After 30 days from the date of sending the notice and public posting, the vehicle registration authority shall issue license plates and vehicle registration certificates to the vehicle user.
In the case of vehicle registration transfer or transfer from one province to another, the vehicle registration office where the vehicle transfer or transfer procedures are carried out shall receive the application and process the procedure within 2 days for those who have transfer documents of the person whose name is on the vehicle registration certificate and transfer documents of the last seller.
In case of not having the above documents, the vehicle registration agency where the vehicle transfer or relocation procedures are carried out will process the transfer or relocation within 30 days.
The Circular also clearly states that the responsibility of the Commune Police is to receive the vehicle registration transfer and transfer declaration with a commitment to take legal responsibility for the vehicle registration procedure of the person using the vehicle. Check and verify the permanent address of the person using the vehicle. After checking and verifying, if correct, confirm the permanent registration address of the person using the vehicle. Processing time is no more than 3 working days.
The Circular takes effect from April 15, 2013.
