Reply:Permanent residence registration (household registration) is when a citizen registers his/her permanent residence with a competent state agency and this agency carries out procedures for permanent residence registration and issues a household registration book.

According to the provisions of the 2006 Law on Residence, citizens who have legal residence in a province can register for permanent residence in that province. In case the legal residence is rented, borrowed, or provided by an individual, the written consent of the lessor, lender, or host must be obtained. Regarding the procedure for permanent residence registration, the person registering for permanent residence must submit a permanent residence registration application to the police agency at the commune or ward level where the permanent residence is to be registered. Clause 2, Article 21 of the Law on Residence stipulates the permanent residence registration application, accordingly, the permanent residence registration application in the province includes the following documents:

- Household registration and population change notification form; population declaration;

- Household registration transfer certificate as prescribed in Article 28 of the Law on Residence.

Thus, the permanent residence registration file must include a household registration transfer certificate. To obtain this certificate, you must apply for a household registration transfer at the commune-level police agency where you previously registered for permanent residence according to the provisions of Clause 3, Article 28 of the Law on Residence. Specifically:

“3. The authority to issue household registration transfer certificates is prescribed as follows:

a) The chief of the commune or town police shall issue a household registration transfer certificate for the case specified in Point a, Clause 2 of this Article;

b) The chief of the district, county, or town police of a centrally-run city, the chief of the town or city police of a province shall issue a household registration transfer certificate for the cases specified in Point b, Clause 2 of this Article.

4. The application for a household registration transfer certificate includes the household registration book and the household registration and population change notification form.

5. Within three working days from the date of receipt of complete documents, the competent authority must issue a household registration transfer certificate to the citizen.

Within ten days from the date of receipt of the notice of acceptance from the residence management agency where the citizen moves his/her household registration to, the police of the district, county, town or city under the province where the person moves must transfer the household registration and management file to the police of the same level where the person moves to.

6. Citizens in one of the following cases do not have to obtain a household registration transfer certificate:

a) Moving within the commune or town of a district in a province; moving within the same district, county or town of a centrally-run city; moving within the same town or city in a province;

b) Students, pupils and trainees studying at schools and other educational institutions;

c) Performing military service or serving for a limited period in the people's police;

d) Being recruited into the people's army or people's police and staying in barracks or collective housing;

d) Serving a prison sentence; executing a decision to send to a reformatory school, educational facility, medical facility, compulsory drug rehabilitation facility, or probation".
