Prime Minister directs to rectify advertising activities

Prime Minister Nguyen Xuan Phuc has just signed Directive 17/CT-TTg on strengthening the effectiveness and efficiency of state management and rectifying advertising activities.

To enhance the effectiveness and efficiency of state management, overcome shortcomings, limitations, and inadequacies, and rectify violations in advertising activities, the Prime Minister requests ministers, heads of ministerial-level agencies, government agencies, and Chairmen of People's Committees of provinces and centrally run cities to be responsible for strengthening management, promptly rectify shortcomings, strictly handle violations, and create positive changes to promote the development of advertising activities nationwide; ensure the rights of advertising participants; create uniformity in the implementation of the Advertising Law and related legal documents, ensure stability, order, and safety, and build a civilized and cultural urban lifestyle. Protect a healthy and honest business environment, protect the legitimate rights and interests of advertising recipients, create conditions for advertising businesses to compete healthily, build a transparent and trustworthy advertising environment, contribute to the development of domestic production and business, and enhance the brand value of Vietnamese goods.

The Prime Minister assigned the Ministry of Natural Resources and Environment to study and complete the provisions of the law on land related to the conversion of land use purposes to serve advertising activities in order to facilitate the implementation in practice. At the same time, direct and guide localities to organize the conversion of land use purposes to carry out advertising activities in accordance with land use planning, plans and provisions of the law on land.

The Ministry of Construction completes the revision of the National Technical Regulation on outdoor advertising media to promptly remove difficulties for localities in the process of applying and developing advertising plans; reports the implementation results to the Prime Minister in the third quarter of 2017.

Strengthen inspection of advertising activities in the press

The Prime Minister assigned the Ministry of Information and Communications to preside over and coordinate with the Ministry of Public Security, the Ministry of Culture, Sports and Tourism and relevant agencies to step up inspection and examination of law compliance in advertising activities in newspapers, publications, on network systems and integrated advertising on postal, telecommunications and information technology products and services; promptly detect and strictly handle violations.

The Ministry of Health, the Ministry of Agriculture and Rural Development, and the Ministry of Industry and Trade shall preside over and coordinate with the Ministry of Culture, Sports and Tourism to appraise advertising products and confirm advertising content for special products, goods and services in the assigned management fields, especially products such as medicine, milk and nutritional foods for children, food and functional foods, cosmetics, pesticides, fertilizers and biological products for cultivation, animal husbandry, etc.; ensure advertising content is consistent with the provisions of law, culture, and customs of the nation.

Vietnam Television, Voice of Vietnam, Radio and Television Stations of provinces and centrally run cities strictly control advertising content before broadcasting; strengthen inspection and examination of the reception of advertising dossiers and strictly implement legal regulations on advertising.

The Prime Minister assigned the Ministry of Culture, Sports and Tourism to review and complete the system of legal documents on advertising activities. Develop a Code of Professional Conduct in Advertising Activities, a Handbook on Outdoor Advertising Planning to guide localities in implementation to ensure consistency and synchronization nationwide. Report to the Prime Minister on implementation results in the third quarter of 2017.

Strengthen the urging and guidance of localities to review the existing advertising system to adjust, supplement, complete the establishment, approval and implementation of advertising planning.

Arrange dedicated locations for classified ads

The Prime Minister requested the Chairmen of the People's Committees of provinces and centrally run cities to focus on directing the strengthening of propaganda and dissemination of legal education on advertising activities on mass media; rectify the presentation in foreign languages ​​on billboards and signs of organizations and individuals; build (arrange) locations specifically for classified advertisements; mobilize mass organizations and communities to participate in removing illegal classified advertisements, contributing to beautifying urban areas.

Arrange funding for the construction and implementation of advertising plans according to the provisions of the State Budget Law; direct the departments and branches: Construction, Transport, Natural Resources and Environment, Planning - Architecture, relevant departments and People's Committees at district and county levels to coordinate with the Department of Culture, Sports and Tourism, Department of Culture and Sports in the construction, implementation and supervision of the implementation of advertising plans; strictly manage advertising activities in the area; review the existing advertising system to adjust or remove according to the approved advertising plan.
