Prime Minister directs to strengthen management of temporary import and re-export activities
The Prime Minister has directed ministries, branches and localities to strengthen state management of temporary import-re-export, transit and bonded warehouse business activities, and to detect, prevent and strictly and promptly handle all violations.
Strengthening management of temporary import, re-export, transit and bonded warehouse storage

The Prime Minister requested the Ministry of Industry and Trade to preside over and coordinate with relevant agencies to review current regulations on temporary import, re-export and transit to implement immediately in accordance with their authority or submit to competent authorities to remove regulations that are no longer suitable; supplement and adjust current regulations to ensure compliance with policies and requirements for strict management of temporary import, re-export and transit activities and with the reality of socio-economic development of our country.
Prohibition of temporary import, re-export and transit of certain types of goods
The Prime Minister requested that in September 2012, the Ministry of Industry and Trade must stipulate and promulgate a list of goods prohibited from temporary import, re-export, and transit for hazardous wastes such as lead batteries, electronic circuit boards; scrap plastic, waste; refrigeration equipment using CFC; chemicals that are precursors that are prohibited from export and import according to international conventions to which Vietnam is a member. The prohibition on temporary import, re-export, and transit of the above items shall take effect from the date of signing and promulgation of this Directive.
At the same time, the Ministry of Industry and Trade must also issue a list of goods temporarily suspended from temporary import for re-export, transit and bonded warehouses, such as used consumer goods and frozen foods such as viscera, by-products of livestock and viscera, by-products of poultry. The temporary suspension of temporary import for re-export, transit and bonded warehouses of these goods will take effect from September 30, 2012.
For shipments on the above temporarily suspended list and temporarily imported and re-exported goods under the License of the Ministry of Industry and Trade not on the list of temporarily suspended temporary import and re-export business arriving at Vietnamese ports before September 30, 2012, temporary import and re-export will continue to be carried out according to the regulations as before this Directive was issued.
The list of other frozen foods (livestock meat, poultry meat, seafood of all kinds) for temporary import and re-export must be carried out under the license of the Ministry of Industry and Trade.
Regulations and announcement of conditions for temporary import, re-export and transit
The Prime Minister also requested the Ministry of Industry and Trade to regulate and announce business conditions for temporary import and re-export, transit of goods subject to special consumption tax (wine, beer, cigarettes, cigars) and goods temporarily imported and re-exported under the license of the Ministry of Industry and Trade.
Specifically, traders must operate in the field of import and export of goods or temporary import and re-export of goods for at least 2 years from the date of establishment to be able to do business in temporary import and re-export and transit of these goods.
Traders must deposit a minimum of VND 5 million to handle environmental treatment and destroy unsold goods that cannot be re-exported, and temporarily imported goods that do not match the declaration and are subject to destruction.
At the same time, the Ministry of Industry and Trade will regulate the issuance of a straight bill of lading for temporarily imported, re-exported and transit goods (clearly stating the name of the consignee and not being transferable). The straight bill of lading must include the license number of the Ministry of Industry and Trade.
Traders engaged in temporary import, re-export and transit business must notify the delivery and receipt plan and details related to the temporary import, re-export and transit shipment to the licensing authority, customs and port authority at least 7 days before the goods arrive at a Vietnamese port.
Regulations on re-export gates
The Prime Minister also directed that temporarily imported and re-exported goods on the list of prohibited exports and imports can only be re-exported through international border gates.
For goods subject to special consumption tax (wine, beer, cigarettes, cigars) re-exported through international border gates and border gates, customs clearance points in border economic zones permitted by the Prime Minister to be established have sufficient specialized control agencies according to regulations. Similar regulations apply to imported goods stored in bonded warehouses for export to third countries.
For frozen food products re-exported through international border gates, main border gates and border gates, customs clearance points in economic zones of border gates permitted by the Prime Minister to be established, there must be sufficient specialized control agencies as prescribed. Store temporarily imported and re-exported goods for no more than 45 days
The Prime Minister noted that it is not allowed to divide containers during the process of transporting goods from the temporary import border gate to the area under customs supervision, the re-export location at the border gate, and the customs clearance point according to regulations.
The time for which goods are stored in Vietnam shall not exceed 45 days; they may only be extended once for no more than 15 days. After this period, traders must re-export them out of Vietnam within 15 days through a temporary import border gate; they are not allowed to go through a border gate other than the temporary import border gate. In case of failure to re-export, they shall be confiscated and handled according to regulations. In case they must be destroyed, the cost of destruction shall be deducted from the trader's deposit.
In particular, it is not allowed to change the business type from temporary import to re-export to import for domestic consumption. Similar regulations apply to goods on the List of goods not encouraged for import.
Regarding temporary import, re-export and transit of petroleum products, the Prime Minister requested regulations and additional conditions for temporary import, re-export and transit of petroleum products according to the Prime Minister's direction in Official Dispatch No. 1136/VPCP-KTTH dated August 1, 2012.
Also according to this Directive, the Prime Minister requested the Ministry of Finance to preside over and coordinate with relevant agencies to amend, supplement or issue new documents under the authority of the Ministry to guide and apply the regulation that only allows traders to re-export goods through the registered border gate when temporarily imported. In case of wanting to change the border gate for re-export, it must be approved by the customs authority of the temporary import border gate; strengthen management measures for temporarily imported and re-exported goods; have measures to closely monitor goods throughout the process from temporary import to re-export, especially when re-exporting.
Supervision of frozen food import for export processing
The Prime Minister also requested the Ministry of Finance to strengthen the direction of inspection and supervision of activities of storing goods with high special consumption tax in bonded warehouses; activities of importing frozen food for export processing, but it is necessary to distinguish it from the case of importing raw materials for processing export goods...
Along with that, the Ministry of Agriculture and Rural Development strengthens strict control and veterinary quarantine of frozen food products for temporary import, re-export and transit; coordinates with authorities of border provinces to direct quarantine agencies at the border to strengthen measures and forces to effectively prevent the transportation of livestock and poultry of unknown origin, not yet quarantined...
