The Standing Committee of the Provincial People's Council will appoint the Chairman, Vice Chairman of the People's Council and People's Committees of new communes and wards.
This is one of the contents in Instruction No. 1309/HD-UBTVQH15, dated June 11, 2025 of the National Assembly Standing Committee "Some contents on the organization and operation of the XV National Assembly Delegation, Provincial and Commune People's Councils for the 2021-2026 term after the 2025 administrative unit arrangement".

According to the Guidelines, the Standing Committee of the Provincial People's Council issues a Resolution appointing personnel to hold the positions of Chairman, Vice Chairman, Head of the People's Council Committee and Chairman, Vice Chairman of the People's Committee of the commune-level administrative units formed after the reorganization.
The Standing Committee of the People's Council at the commune level shall issue a Resolution appointing personnel to hold the position of Commune-level People's Committee member of the commune-level administrative units formed after the reorganization, immediately after the Resolution of the Standing Committee of the Provincial People's Council appointing personnel to hold the positions of the Standing Committee of the People's Council at the commune level takes effect.
Regarding the composition of the People's Council at the commune level for the 2021-2026 term in the newly formed administrative units after the rearrangement, the Guidelines clearly state that they include: People's Council delegates of commune-level administrative units before the rearrangement; People's Council delegates at the district level who have been elected in the administrative boundaries of communes, wards, and special zones formed after the rearrangement; People's Council delegates at the district level who are performing their duties as delegates in the administrative boundaries of communes, wards, and special zones formed after the rearrangement; and People's Council delegates at the district and commune levels who are mobilized and arranged by competent authorities to work at agencies, organizations, and units of local governments in commune-level administrative units before the rearrangement (before the district-level administrative units cease to operate).
To ensure the basis for personnel appointment, the Standing Committee of the District People's Council is responsible for reviewing the list of People's Council delegates and basing on the personnel plan approved by the competent authority to develop a plan for arranging People's Council delegates at the commune level after timely arrangement and sending it to the Standing Committee of the Provincial People's Council. The Standing Committee of the Provincial People's Council shall carry out the appointment of People's Council delegates in accordance with the provisions of the Law on Organization of Local Government (amended).
The organizational structure of the People's Council at the commune-level administrative unit formed after the rearrangement includes: the Standing Committee of the People's Council (Chairman, Vice Chairmen, Heads of the People's Council Committees), the People's Council Committees, the People's Council Delegation Groups and the People's Council delegates. The People's Council delegates at the commune level formed after the rearrangement will continue to operate until the end of the 2021-2026 term.
The number of Vice Chairmen of the People's Council and Vice Heads of the Committees who are full-time People's Council delegates of the People's Council at the commune level formed after the arrangement is implemented according to the provisions of the Law on Organization of Local Government (amended).
Notably, Instruction No. 1309 also clearly stipulates how to determine the key of the People's Council at the commune level after establishing a new administrative unit.
Accordingly, in case the newly formed administrative unit after the rearrangement retains the name of one of the administrative units before the rearrangement, the term of the People's Council in the administrative unit after the rearrangement will continue to be calculated according to the term of the People's Council in the administrative unit that retains the same name.
In case a newly formed administrative unit after rearrangement changes its name or changes the type of administrative unit, the term of the People's Council in the administrative unit after the rearrangement shall be recalculated from the beginning (Term I) from the time of establishment.
Implementing the Central Government's directive documents, Nghe An province has proactively focused on developing a project to rearrange commune-level administrative units in the province by 2025.
According to the arrangement plan submitted to the Provincial People's Council, the whole province currently has 412 commune-level administrative units (including 362 communes, 33 wards, and 17 towns). After the arrangement, Nghe An province has 130 commune-level administrative units (including 11 wards, 119 communes); a reduction of 282 commune-level administrative units (including 243 communes, 22 wards, and 17 towns), a reduction rate of 68.45%.
In 130 commune-level administrative units, there are 122 new communes formed after the arrangement, 8 communes remain the same.
