How are overtime and night work wages calculated?

Overtime on holidays will be paid at a maximum of 300% compared to normal working days.

The Ministry of Labor, War Invalids and Social Affairs has just issued Circular 23/2015/TT-BLDTBXH guiding the implementation of a number of provisions on wages.

Accordingly, wages for night work will be calculated according to the following formula:

Night work wages = { Actual hourly wages paid on a normal working day or Unit price of product wages on a normal working day + Actual hourly wages paid on a normal working day or Unit price of product wages on a normal working day X At least 30% rate } X Number of night work hours or Number of products worked on a night.

Overtime pay for employees who receive hourly wages is paid overtime when working outside of normal working hours as prescribed by the employer according to Article 104 of the Labor Code and is calculated as follows:

Overtime pay = { Actual hourly wage paid on a normal working day x Minimum rate of 150% or 200% or 300% x Number of overtime hours}

In which, the actual hourly wage paid for a normal working day is determined based on the actual wage paid for the current work of the month in which the employee works overtime (excluding overtime wages, extra wages for night work) divided by the actual number of hours worked in the month (excluding overtime hours). In case of daily or weekly wages, the actual hourly wage paid is determined based on the actual wage paid for that working day or week (excluding overtime wages, extra wages for night work) divided by the actual number of hours worked in the day or week (excluding overtime hours);

The rate is at least 150% of the actual hourly wage paid on a normal working day, applicable to overtime hours worked on a normal day;

The rate is at least 200% of the actual hourly wage paid on a normal working day, applicable to overtime hours worked on a weekly day off;

The minimum wage is 300% of the actual hourly wage of a normal working day, applicable to overtime hours on holidays, New Year's Day, and paid leave days, not including wages for holidays, New Year's Day, and paid leave days as prescribed by the Labor Code, for employees receiving daily wages.

Daily wage workers are those whose agreed wages are recorded in the labor contract on a daily basis and do not include wages for holidays, Tet, and paid leave days as prescribed by the Labor Code.

For employees paid by product, overtime is paid when the employee and employer agree to work outside of normal working hours to do additional quantity, volume of products, work beyond the quantity, volume of products, work according to the agreed labor norms and is calculated as follows:

Overtime wages = { Unit price of product wages of a normal working day x Minimum rate of 150% or 200% or 300% x Number of overtime products}

In which, the minimum level is equal to 150% compared to the unit price of product salary of a normal working day, applied to overtime products on a normal day;

The rate is at least 200% of the product salary unit price of a normal working day, applied to overtime products on weekly days off;

The minimum wage is 300% of the product unit price of a normal working day, applied to overtime products on holidays, New Year's Day, and paid leave days.
Circular 23/2015/TT-BLDTBXH takes effect from August 8, 2015 and the regimes in this Circular are implemented from March 1, 2015./.
