Constitutional Amendment: Consulting the People



In his closing speech, General Secretary Nguyen Phu Trong clarified a number of issues and summarized the important results achieved by the conference.

Constitutional Amendment: Consulting the People

Regarding the summary, amendment and supplementation of the 1992 Constitution, the General Secretary emphasized that this is a very large and especially important content of this conference. Amending and supplementing the Constitution is an objective and necessary requirement. The Central Committee has reviewed and discussed the report of the Committee for Drafting Amendments and Supplements to the Constitution, basically agreeing with many contents; at the same time, continuing to emphasize that amending and supplementing the Constitution is an especially important and sensitive task, requiring a comprehensive, dialectical, specific, historical viewpoint and perspective, with a scientific and cautious approach; avoiding speculative thinking, far from reality.

Proposals for amendments and supplements must be based on the results of a thorough review of the actual implementation of the 1992 Constitution and related laws; fully grasp the requirements for institutionalizing the Platform for national construction in the transitional period to socialism (supplemented and developed in 2011) and the Resolution of the 11th National Party Congress; and continue to inherit the provisions of the 1992 Constitution and previous Constitutions that are still relevant.

Regarding the amendment process, the conference agreed that it is necessary to follow the spirit of Resolution No. 2 of the Central Committee (11th tenure), conduct it closely and scientifically, under the leadership of the Party; have a mechanism to ensure the participation of experts, scientists, managers and organize to widely collect public opinions on the amendment contents, so that the National Assembly has a full basis to consider and decide.

Along with giving opinions on the orientation of basic contents that need to be supplemented and amended in the 1992 Constitution, the Central Committee also contributed many important opinions to specific options, clarifying the advantages and disadvantages of each option so that the Constitutional Amendment Drafting Committee can continue to consider and select.

Land use rights are not ownership rights.

The conference unanimously agreed that: Land is an extremely valuable national resource, a special means of production, a source of livelihood for the people; an asset, a great resource of the country. It is necessary to continue to affirm that land belongs to the entire people, represented by the State as the owner and managed in a unified manner; at the same time, it is necessary to clearly and specifically stipulate and more fully and correctly implement the rights of the owner's representative and the State's unified management rights... Land use rights are also a special type of property and commodity, but they are not ownership rights. The State does not recognize the reclaiming of land that has been assigned by the State to others for use in the process of implementing land policies; it does not raise the issue of readjusting agricultural land assigned to households and individuals.

Urgently study and amend the Land Law and perfect the land law to promptly overcome the current limitations and weaknesses, better meet the requirements of reasonable allocation, proper land use, economy and efficiency, ensuring immediate and long-term benefits, and protecting the ecological environment. Improve the quality and protect agricultural land, ensure national food security, maintain political and social stability and sustainable development. Develop a healthy real estate market, including land use rights, ensuring the harmony of interests of the State, people and investors.

Continue to allocate and lease agricultural land to households and individuals for a limited period, but it can be extended to encourage farmers to be more attached to their fields and feel secure in investing in production. At the same time, expand the limit for receiving agricultural land use rights transfer in accordance with the specific conditions of each region, to create favorable conditions for the process of land accumulation and concentration, gradually forming large commodity production areas in agriculture.

The Central Steering Committee against Corruption under the Politburo

The conference agreed that since the issuance of Resolution 3 of the 10th Central Committee, the agencies of the Party, the State, the Fatherland Front and the entire political system have been proactive and active in the fight against corruption and waste. The work of preventing and combating corruption and waste has had positive changes in both awareness and action, especially in preventing, publicizing and making transparent the operations of the state apparatus, reforming administrative procedures, and managing public assets; in some areas, corruption and waste have been gradually curbed. However, the work of preventing and combating corruption has not yet met the requirement of "preventing and gradually repelling corruption".

The Central Committee emphasized that it is necessary to persevere and promote the task of fighting against corruption and waste... Enhance the role and responsibility of Party committees at all levels, authorities and leaders; supplement and perfect mechanisms, policies and laws on economic and social management; strengthen organization and personnel work; improve the effectiveness and efficiency of detecting and handling corruption and waste; expand democracy, publicity and transparency; promote the supervisory role of the National Assembly, People's Councils, the Fatherland Front, the people and public opinion.

The Central Committee agreed on the policy of establishing the Central Steering Committee on Anti-Corruption under the Politburo; re-establishing the Central Internal Affairs Committee, which both performs the functions of a Party committee and is the standing body of the Central Steering Committee on Anti-Corruption.
Social security

Regarding social policy, the Central Committee requires that in the coming time, it is necessary to seriously grasp the Party's viewpoints and guiding thoughts, considering the continuous improvement and enhancement of material and spiritual life for people with meritorious services and ensuring social security as a regular and important task of all levels, sectors, the entire political system and the responsibility of the whole society. Strive by 2015 to basically complete the goal of ensuring that families of people with meritorious services have a minimum standard of living equal to the average standard of living of the local population; by 2020, basically ensure social security for all people, ensuring a minimum level of income, education, health care, housing, clean water and information.

To do so, we must focus on perfecting and organizing the implementation of laws, policies, tasks and social solutions, focusing on job creation, income; social insurance; social assistance; ensuring a minimum level of some basic social services for the whole society, especially the poor, ethnic minorities and people in difficult circumstances.

Incentive policies for meritorious people and social security must be consistent with the level of socio-economic development and the country's ability to balance and mobilize resources; priority must be given to people in particularly difficult circumstances, the poor and ethnic minorities. The social security system must be diverse, comprehensive, ensuring fairness and sustainability, sharing among population groups within a generation and between generations, between the State, enterprises and workers. The State must ensure good implementation of preferential policies for meritorious people; at the same time, play a leading role in organizing the implementation of social security policies; promote socialization, encourage organizations, enterprises and people to participate...

Reviewing salaries in state-owned enterprises

Regarding the issue of wages and social insurance, the Central Committee requested that in 2012-2013, it is necessary to urgently supplement and amend a number of policies that need and can be adjusted immediately to quickly overcome current outstanding irrationalities; prioritize salary adjustments for cadres, civil servants, public employees and armed forces in conjunction with overcoming the situation of too many types of allowances; review the salary regime in state-owned enterprises, overcome the unreasonable situation, too large difference between managers and workers; wages and incomes are not linked to production and business results.

Promote innovation and reorganization of public service units in the spirit of the Conclusion of the 6th Central Conference (10th tenure). Seriously implement the Project on restructuring state-owned enterprises in the spirit of the Conclusion of the 3rd Central Conference (11th tenure)... Adjust preferential allowances for meritorious people, pensions and social insurance allowances along with the increase and time of adjusting the minimum wage of cadres and civil servants... At the same time, urgently research and develop the Project on reforming the salary regime for the period 2013 - 2020 along with related projects, creating a breakthrough in creating resources, ensuring salary reform, and achieving results.

Synchronously carry out salary reform with administrative reform, streamline the organizational apparatus, payroll, restructure public finance and other related fields; link salary adjustment with adjustment of social insurance policy and preferential allowances for meritorious people.

General Secretary Nguyen Phu Trong suggested that immediately after this conference, each member of the Central Committee should further promote their individual roles and responsibilities, together with the Party Committee and the Government, to lead and organize the effective implementation of the resolutions and conclusions of this Central Committee conference, as well as other resolutions of the Party, the National Assembly and the Government; ensuring the successful completion of the socio-economic development goals and tasks in 2012.
