Standards and conditions for registration for professional title promotion

Decree 85/2023/ND-CP of the Government stipulating standards and conditions for registration for promotion of professional titles takes effect from December 7, 2023.

The Government issued Decree 85/2023/ND-CP amending a number of articles of Decree 115/2020/ND-CP dated September 25, 2023 on recruitment and management of civil servants, including amending the standards and conditions for registration for consideration of promotion of professional titles.

Specifically, civil servants are eligible to register for promotion to the next higher professional title when they meet the following criteria and conditions:

+ Being classified as having completed tasks well or better in the working year immediately preceding the year of consideration for promotion to professional title; having good political qualities and professional ethics; not being subject to disciplinary action; not being subject to disciplinary regulations according to Party and law regulations.

+ Have the capacity, professional qualifications and skills to take on a professional title at a level higher than the current professional title in the same professional field.

+ Meet the requirements for diplomas, certificates and other requirements of the professional title standards for promotion consideration. In case at the time of promotion consideration, the Ministry of Professional Title Management for specialized civil servants has not issued regulations on the content, program, form and duration of training, then the requirements for professional title training certificates are not required; civil servants considered for promotion are considered to meet the standards and conditions of the considered rank.

+ Meet the minimum working time requirement to hold the next lower professional title according to the requirements of the professional title standards for promotion consideration, except in the case of consideration for promotion of a professional title where the professional title, according to regulations at the time of consideration, does not have a next lower rank.

In case an employee, before being recruited or accepted, has had a working period (not including probationary period) in accordance with the provisions of law, has paid compulsory social insurance, worked in a job position with requirements on appropriate professional qualifications and skills (if there is a non-continuous working period without receiving a one-time social insurance subsidy, it will be accumulated) and that time is calculated as the basis for salary classification in the current professional title, it will be considered equivalent to the current professional title rank.

In case of calculating equivalent time, the time holding the next lower professional title compared to the professional title rank under consideration must be at least 12 months from the deadline for submitting the application for promotion consideration.

In addition to the standards and conditions prescribed above, the Ministry of Management of Professional Titles of Specialized Civil Servants is responsible for specifying the standards and conditions for promotion consideration in cases of promotion to Grade II and Grade I in the management sector and field associated with the requirements of the job position corresponding to the professional title level under consideration, ensuring the requirements for improving the quality of the team and the rights of civil servants.

The Ministry of Home Affairs specifically prescribes the standards and conditions for promotion to grade II and grade I applicable to administrative officers, clerical officers and archival officers.

For grade V and grade IV officials, they will be considered for promotion to the next higher professional title if they are working in a job position suitable for the considered professional title and meet the criteria and conditions for consideration according to the above regulations.

In the case of civil servants currently ranked in a professional title rank that is no longer regulated by current law, they will be considered for promotion to a higher professional title rank next to the current professional title rank if they are working in a suitable job position and meet the standards and conditions as prescribed. This provision does not apply to cases where there is a change in the professional title code.

The head of the public service unit organizes the promotion review.

Decree 85/2023/ND-CP amends Article 33 on assignment and decentralization of organization for considering promotion of professional titles and authority to manage and use civil servants of public service units.

In which, the head of the public service unit specified in Clause 1, Article 7 of this Decree (for public service units ensuring regular and investment expenditures and public service units ensuring regular expenditures, the head of the public service unit shall carry out the recruitment of civil servants):

+ Organize the review and promotion of professional titles of grade I with salary classification A3 according to decentralization and authorization.

+ Organize the review and promotion of professional titles of grade I with salary classification A2 and from grade II and below for civil servants working at public service units in accordance with the job position and staff structure according to approved professional titles.

+ Decision on appointment of professional titles, salary classification, salary increase (regularly, ahead of schedule), seniority allowance exceeding the framework for civil servants holding professional titles of grade I or lower (including professional titles of grade I with salary classification of civil servants of type A3) within the scope of management.

The assignment and decentralization of organization of professional title promotion examination in public service units of political organizations and socio-political organizations shall be implemented according to regulations of competent Party agencies.

Salary ranking of civil servants who passed the professional title promotion exam

Decree 85/2023/ND-CP also amends Article 42 on appointment and salary classification of professional titles for civil servants who pass the professional title promotion exam.

Specifically, within 15 days from the date of receiving the list of officials who passed the professional title promotion examination, the head of the competent authority or the delegated or authorized person must make the appointment and salary arrangement in the new professional title for the officials who passed the examination according to regulations.

In case an official has passed the promotion exam but is later considered for disciplinary action or disciplined or prosecuted, investigated, prosecuted, or tried, a decision on appointment and salary classification at the successful professional title has not been issued.

When the disciplinary period expires without being disciplined or the disciplinary decision has expired or after the competent authority has made a decision on the case of being prosecuted, investigated, prosecuted or tried, then based on the structure of civil servants according to the approved professional titles at the time of consideration and appointment decision, the competent authority shall decide on the appointment and salary classification of the professional title for the civil servant who passed the examination in the professional title promotion period.

The time for receiving the new salary, the time for considering the next salary increase, and the extension of the salary increase period (if any) shall be implemented according to the provisions of law.

Salary arrangement for newly appointed professional positions is implemented according to the provisions of law.
