(Baonghean.vn) - On the afternoon of September 25, the Provincial National Assembly Delegation held a conference to collect comments on the draft Law on Organization of Criminal Investigation Agencies to serve the 10th session of the 13th National Assembly.

Attending were representatives of the leaders of the People's Council, People's Committee, Fatherland Front Committee of the province, Provincial Border Guard and representatives of relevant departments, branches and sectors.

Conference overview

The Draft Law on Organization of Criminal Investigation Agencies drafted by the Ministry of Public Security has 10 chapters and 72 articles. The Draft Law stipulates the principles of organization, coordination, supervision and control of criminal investigation activities; the organization, tasks and powers of investigation agencies and agencies assigned to conduct certain investigation activities; investigators and other positions in criminal investigation and the responsibilities of relevant agencies, organizations and individuals.

The draft law is built on the spirit that the arrested, detained, and accused are considered innocent until proven guilty according to the procedures prescribed by the Criminal Procedure Code and have a legally effective court verdict. The draft also has many new points on the organizational model of the investigation agency; assigns some investigation activities to the police of communes, wards, towns, stations, and stations; proposes to stipulate additional titles of investigation assistants, etc.

Contributing opinions to the draft Law on Organization of Criminal Investigation Agencies, the majority of delegates basically agreed with the content and structure of the draft Law. Regarding a number of agencies assigned to conduct a number of investigative activities, many opinions suggested adding a number of crimes under the investigative authority of the Border Guard and Fisheries Control Force to meet the practical requirements of the fight against crime and law violations in border and sea areas and increasing the investigation period for all agencies assigned to conduct a number of investigative activities.

In fact, most crimes occurring in inland areas occur in border areas where the border guards are the core, specialized and leading force, coordinating with the people's police force, relevant sectors and local authorities in managing and protecting the national border, maintaining security, order and social safety in border areas.

Regarding the content on the organization of the Criminal Police Department, the majority of delegates agreed with the draft Law on merging the Department of Police Investigation of Crimes of Corruption with the Department of Police Investigation of Crimes of Economic Management Order and Positions and establishing the Department of Police Investigation of Crimes of Smuggling.

Regarding the responsibilities of the commune, ward, town police, and police stations, all opinions agree with the provisions of the draft Law. In reality, in many cases, the commune, ward, town police, and police stations are the direct and first agencies to receive denunciations and reports of crimes, detect and arrest, receive criminals caught red-handed, and wanted persons, so assigning these agencies to receive denunciations and reports of crimes and carry out a number of activities to support investigations as stipulated in the draft Law is appropriate, especially in remote areas, areas with particularly difficult socio-economic conditions.
